"~ RESOLUTION NO. 99-350 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON A PORTION OF SECTIONS 4 AND 5, IN TOWNSHIP 20 NORTH, RANGE 17 WEST, FOR TWO COMMERCIAL MODULAR BUILDINGS IN A M-X (HEAVY MANUFACTURING) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by James O. Blaschak, Plant Engineering Facilitator for North Star Steel Arizona, Kingman, Arizona, and WHEREAS, this property is located east o£ Interstate 40 and north of the McConnico/Interstate 40 interchange. The site is accessed £rom Interstate 40 via the McConnico exit to the eastern fi-ontage road known as Old US Highway 66, then north on the eastern frontage road to the site, located approxin~ately one-half mile on the west side of the frontage. The property has a steel recycling mill on it along with associated accessory buildings. The surrounding land uses consist of other general commercial and industrial businesses along Interstate 40. There are no significant drainage pa~terns, and WHEREAS, the applicant requests this Zoning Use Permit for two commercial modular buildings in a M-X (Heavy Manufacturing) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040055-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the £ollowing described Findings of Fact are £or the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended APPROVAL for a Zoning Use Pernfit subject to the following: RESOLUTION NO. 99-350 Page 2 1. This Zoning Use Permit is for two conmaemial modular buildings in a M-X (Heavy Manufacturing) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and posted on August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~C~OARD OF SUPERVISORS Buslter D.
