WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway right-of-way as requested by the Mohave County Public Works Department for the National Park Service, Washington, D.C., and WHEREAS, this roadway is located west of Pierce Ferry Road and north of Delmar Drive. The site is accessed from Pierce Ferry Road via west-southwest on Delmar Drive to Starlight Way, then north- northeast on Starlight Way, approxiraately three-eighths (%) of a mile to its intersection with Ridge Circle. The proposed abandonment extends from this intersection northwest to its terminus. The roadway has not been improved. The terrain is hilly. Residential development has not occurred along the roadway. There are no significant washes crossing this property, and WHEREAS, the applicant proposes to abandon the roadway to incorporate it into the Lake Mead Recreation Area. All properties accessed from this roadway axe owned by the National Park Service. The Mohave County General Plan designates this area as a Rural Development Area and Outlying Community, and WHEREAS, the Mohave County Department of Public Works is in favor of the abandonment, and WHEREAS, Citizens Utilities has no objection to the proposed roadway abandonment, and WHEREAS, a review of FEMA FIRM Panel #040058-1275B indicates the parcel described to be in Zone C, not in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. RESOLUTION NO. 99-355 Page 2 d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Plamfing and Zoning Conunission on August 11, 1999, the Commission recommended APPROVAL for the Abandonment subject to the following: 1. The entire right-of-way for Ridge Circle shall be abandoned. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and August 25, 1999, and posted August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
