OF 2 ~iOHAVE COUNTY BOARD OF SOPERViSO~,:E ~'~ RECORDING FEE RESOLUTION NO. 99-357 A RESOLUTION SETTING FORTH AN ABANDONMENT OF TEMPLE BAR DRIVE, FROM ITS INTERSECTION WITH JAMAICA DRIVE, NORTHERLY TO ITS INTERSECTION WITH PIERCE FERRY ROAD IN SECTION 15, TOWNSHIP 30 NORTH, RANGE 17 WEST, IN THE MEADVIEW PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public heating was conducted to determine whether approval should be granted to abandon the above-described roadway tight-of-way as requested by the Mohave County Public Works Depaxtment for the National Park Service, Washington, D.C., and WltEREAS, this roadway is located east of Pierce Ferry Road and south of Delmar Drive. The site is accessed directly from Pierce Ferry Road and extends approximately one-half (V2) of a mile east then south to its terminus. The roadway has not been improved. The terrain is composed of rolling hills. Residential development has not occurred along the roadway. There are no significant washes crossing this property, and WHEREAS, the applicant proposes to abandon the roadway to incorporate it into the Lake Mead Recreation Area. All properties accessed from this roadway are owned by the National Park Service. The Mohave Cous~ty General Plan designates this area as a Rural Development Area and Outlying Community, and WHEREAS, the Mohave County Depaxtment of Public Works is in favor of the abandonment, and WHEREAS, Citizens Utilities has no objection to the proposed roadway abandomnent, and WHEREAS, a review of FEMA FIRM Panel #040058-1275B indicates the parcel described to be in Zone C, not in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. RESOLUTION NO. 99-357 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Cmmnission on August 11, 1999, the Commission recommended APPROVAL for the Abandonment subject to the following: I. The entire right-of-way for Temple Bar Drive shall be abandoned. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and August 25, 1999, and posted August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, APPROVED this Abandonment as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
