HomeMy WebLinkAbout99-358 RESOLUTION NO. 99-358 A RESOLUTION SETTING FORTH AN ABANDONMENT OF MEAD CIRCLE NORTH, MEAD CIRCLE SOUTH, AND THE MEAD CIRCLE NORTH AND SOUTH ACCESS ROAD, AKA DELMAR DRIVE, BEGINNING AT THE INTERSECTION OF THE ACCESS ROAD AND PIERCE FERRY ROAD, THEN EASTERLY ALONG THE ACCESS ROAD TO THE EAST SECTION LINE OF SECTION 15 AND THE INTERSECTION OF THE ACCESS ROAD AND MEAD CIRCLE NORTH AND MEAD CIRCLE SOUTH, THEN FROM THIS INTERSECTION NORTHERLY ALONG MEAD CIRCLE NORTH TO 1TS TERMINUS AND SOUTHERLY FROM THIS SAME INTERSECTION ALONG MEAD CIRCLE SOUTH TO ITS TERMINUS IN SECTION 15, TOWNSHIP 30 NORTH, RANGE 17 WEST, 1N THE MEADVIEW PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 1999, a public hearing was conducted to determine whether approval should be granted to abandon the above-described roadway right-of-way as requested by the Mohave County Public Works Department for the National Park Service, Washington, D.C., and WHEREAS, th/s roadway is located west of Pierce Ferry Road and north of Temple Drive. The site is accessed directly from Pierce Ferry Road and extends approximately 200 feet east to the intersection of Mead Circle North and Mead Circle South. The abandonment continues and extends approximately one- quarter (¼) of a mile south to the terminus of Mead Circle South and one-eighth (1/8) of a mile north to the terminus of Mead Circle North. The roadways have not been improved. The terrain is composed of rolling hills. Residential development has not occurred along the roadway. There are no significant washes crossing this propert7, and WHEREAS, the applicant proposes to abandon the roadway to incorporate it into the Lake Mead Recreation Area. All properties accessed from this roadway are owned by the National Park Service. The Mohave County General Plan designates tiffs area as a Rural Development Area and Outlying Community, and WHEREAS, the Mohave County Department of Public Works is in favor of the abandonment, and WHEREAS, Citizens Utilities has no objection to the proposed roadway abandonment, and WHEREAS, a review of FEMA FIRM Panel #040058-1275B indicates the parcel described to be in Zone C, not in the Special Flood Hazard Area, and RESOLUTION NO. 99-358 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WItEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 11, 1999, the Commission recommended APPROVAL for the Abandonment subject to the following: 1. The rights-of-way for Mead Circle North, Mead Circle South and Delmar Drive, lying east of Pierce Ferry Road, shall be abandoned per Exhibit "A." WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, August 18, 1999, and August 25, 1999, and posted August 20, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Tuesday, September 7, 1999, APPROVED this Abandonment as recommended by the Mohave County Plarming and Zoning Commission and outlined herein .~ / ~7 MOI-Ifi ~E CO~UNT¥/~ARD OF SUPERVISORS Bust~ ).
