HomeMy WebLinkAbout99-365 RESOLUTION NO. 99-365 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A PORTION OF THE NE¼ OF SECTION 5, LYING WESTERLY OF OLD HIGHWAY 91 AND SOUTHERLY OF OLD PIONEER ROAD, IN TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM A (GENERAL) ZONE TO C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at thc regular meeting of the Mohavc County l~oard of Supervisors held on October 4, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by l~eaver Dam Arizona S~rip, a Utah Partnership, of Ogden, Utah, and WHEREAS, this property is located on the west side of County Highway 91, between the Interstate 15/County Highway 91 intersection and Old Pioneer Road. The site is accessed directly from Cotmty Highway 91 to the west. The property is vacant and the terrain is relatively fiat, sloping slightly to the west toward thc Virgin River. The surrounding land uses consist of vacant land and single-family residences. To the east is the l~eavcr Dam Resort mobile home park. There are no signi£~cant drainage pal:terns. The Mohavc Comaty General Plan designates this area as an Urban Development Area and the Virgin River Communities Area Plan designates this area as a Conrmercial [C-2 (General Conm~ereial) and C-2H (General Commercial l~Iighway Frontage)] Development Area, and WHEREAS, this rezone was conditionally approved by the Mohave County l~oard of Supervisors on May 4, 1998 via I~OS Resolution No. 98-164, and WHEREAS, this Extension of Time will allow the applicant time to complete the conditions as required by BOS Resolution No. 98-164 as requested in their letter dated July 8, 1999, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by I~OS Resolution No. 98-164, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: RESOLUTION NO. 99-365 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan and the Virgin River Communities Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. fi There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 8, 1999, the Conunission recommended APPROVAL for an Extension of Time for a Rezone subject to the following: 1. Compliance with the conditions of BOS Resolution No. 98-164. 2. This Extension of Time will be in effect antil May 4, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
