HOHAVE COUNTY BOARD OF o .. p oI ~, RECORDING FEE D,00 RESOLUTION NO. 99-366 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A REZONE OF A PORTION OF THE SE¼ OF SECTION 34, TOWNSHIP 41 NORTH, RANGE 15 WEST AND A PORTION OF THE N~ OF SECTION 3, TOWNSHIP 40 NORTH, RANGE 15 WEST, FROM R- E/10A (RESIDENTIAL-RECREATION/TEN ACRE MINIMUM LOT SIZE) ZONE TO C-RE (COMMERCIAL-RECREATION) ZONE, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1999, a public hearing was conducted to determine whether an Extension of Time for a Rezone should be granted for the above-described property as requested by William L. Gates of Grand Junction, Colorado, representing the new owners of the property, STIEJUM, 1NC., of Mesquite, Nevada, and WHEREAS, this property is located north of Interstate 15 and east of the 1-15 Farm Road Exit in the Littlefield area. The site is accessed from Interstate 15 via the 1-15 Farm Road Exit to the Frontage Road, then northeast on the Frontage Road to the site, located on the north side of the road. The property is vacant and relatively fiat, sloping slightly to the north and west toward the Virgin River. There are several significant drainage partems crossing the property, mostly along the northern part toward the Virgin River. The Mohave County General Plan designates this area as an Urban Development Area and an Outlying Community. The Virgin River Communities Area Plan designates this area as COM (Commercial, C-2 [General Commercial] and C-2H [General Commercial Highway Frontage]) and MDR (Medium Density Residential [5 to 12 Dwelling Units/Acre]), and WHEREAS, this rezone was conditionally approved by the Mohave County Board of Supervisors on August 7, 1995, via BOS Resolution No. 95-313. It was extended for the first time with BOS Resolution No. 96-361 on November 4, 1996. A second Extension of Time was granted on April 6, 1998, via BOS Resolution No. 98-101. It was extended for a third time on February 1, 1999, with BOS Resolution No. 99- 37, and WHEREAS, the property has changed ownership to STIEJUM, INC., of Mesquite, Nevada and claim to be formulating plans as to how development will proceed as noted in Mr. W. L. Gates' letter of August 3, 1999, and WHEREAS, this will be the fourth Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-0025B indicates that a portion of the parcel described is in Zone A, in the Special Flood Hazard Area, and PAGE 2 OF 2 BE 33?0 Pti ?07 FEE~?90611!? RESOLUTION NO. 99-366 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised mad posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan and the Virgin River Communities Area Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant envirorunental features affecting the site, except the noted Special Flood Hazard Area. g. This request DOES NOT comply with the Extension of Time Policy, as Mr. Gates has made no progress in accomplishing the conditions of approval of BOS Resolution No. 95-313. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Comnfission on September 8, 1999, the Conunission recommended DENIAL for an Extension of Time for a Rezone based upon the following: 1. This is the fourth request for an Extension of Time and the applicant has made little progress in completing this development. 2. This request DOES NOT comply with the Extension of Time Policy. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 4, 1999, considered explanations from the applicants and APPROVED this Extension of Time for a Rezone subject to the following conditions: 1. Compliance with the conditions of BOS Resolution No. 95-313. 2. This Extension of Time will be in effect until August 7, 2000. 3.
