HomeMy WebLinkAbout99-368 RESOLUTION NO. 99-368 A RESOLUTION SETTING FORTH A SUBDIVISION FINAL PLAT FOR SUNLAKE VILLAGE, TRACT 3700-C, BEING A SUBDIVISION OF A PORTION OF THE S~ OF SECTION 21, TOWNSHIP 14 NORTH, RANGE 20 WEST, IN THE LAKE HAVASU CITY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1999, a public hearing was conducted to determine whether the Final Plat should be approved for the above-described subdivision, and WHEREAS, the ounaer/developer of this property is Sunlake Village, LLC. The engineer of record is A-N West, Inc., Bullhead City, Arizona, and WHEREAS, the property is located inmaediately north of Lake Havasu City. The property is accessed directly via State Highway 95, and west along and south of Lake Drive, and WHEREAS, the revised Preliminary Plan depicts 56 acres subdivided into 160 single-family residential lots and several parcels. The residential lots range in size from 7,500 to 13,230 square feet. A conditionally commercial parcel that had been included in Tract 3700 was administratively removed from the tract in 1996 to process separately, at the request of the developer. The subdivision is being platted in four phases, and WHEREAS, the Preliminary Plan for Sunlake Village, Tract 3700, was conditionally approved by the Board of Supervisors on January 3, 1994, per BOS Resolution No. 94-3. A revised Preliminary Plan was conditionally approved by the Board on February 6, 1995, per BOS Resolution No. 95-30, and was given a new two-year period of approval, and WHEREAS, the Final Plat for Tract 3700-A was recorded on November 8, 1995. The Final Plat for Tract 3700-B was recorded on February 23, 1998. Improvements have been completed for the first two phases of this subdivision and all assurances released per BOS Resolution Nos. 97-2 and 98-396, for phases A and B respectively, and WHEREAS, the developer has proposed the use of a trust agreement as an assurance to Mohave County that all required improvements and, in addition, all proposed improvements for this subdivision will be constructed. The County Attorney's Office has indicated no objection to the form of the trust agreement being used as the assurance. The County Engineer has approved the project engineer's cost estimate for the subdivision improvements, in the amount of $ 346,877.30 (Three Hundred Forty-six Thousand, Eight Hundred Seventy-seven Dollars, and Thirty Cents), and RESOLUTION NO. 99-368 Page 2 WHEREAS, the advertising requirements have been met throughout this subdivision process as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. The notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 4, 1999, APPROVED the Final Plat for Sunlake Village, Tract 3700-C, subject to the following conditions: 1. A current title report (dated within 30 days of recordation) must be furnished to the Planning and Zoning Department prior to plat recordation. 2. The developer will make the same commitments for improvements in the prospectus to the State Real Estate Comnfission as required for approval of this tract by the Board, and a final copy of the State Real Estate Report shall be submitted to the Planning and Zoning Department. 3. The Arizona Department of Environmental Quality Approval of Sanitary Facilities for Tract 3700-C must be submitted to the Planning Director prior to the recordation of this Final Plat. 4. Lots within the recorded Final Plat of this development will not be further divided. 5. Executed copies of contracts with utility providers and written statements from those providers demonstrating the completion of utility improvements shall be provided to the Planning Director prior to the recordation of this Final Plat. A lack of such documentation will require a reconsideration by the Board of Supervisors of this Final Plat, as the County Engineer-approved cost estimate referenced in this resolution does not include dollar amounts for the utility improvements for this subdivision. NOW THEREFORE BE IT FURTHER RESOLVED, that a correct copy of all documents delineated above shall be submitted to Planning and Zoning for distribution and review. Upon receipt of evidence that these conditions have been met, together with the executed mylars and appropriate recording fees, the Director of Planning and Zoning will obtain the necessary signatures firom the County departments ause the Final Plat for Sunlake Village, Tract 3700-C, to be recorded. : }i~ ''~ ~OH~AV~COUNTY BOARD OF SUPERVISORS ~< Buster D. ~hnson, Chairman
