RESOLUTION NO. 99-371
A RESOLUTION SETTING FORTH AN AMENDMENT TO BOS RESOLUTION NO. 93-52
SETTING FORTH A ZONING USE PERMIT ON THE NW% SE¼ NE¼ OF SECTION 32,
TOWNSHIP 15 NORTH, RANGE 20 WEST, FOR THE ESTABLISHMENT OF A RADIO
COMMUNICATIONS SITE 1N AN A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX
ACRE MINIMUM LOT SIZE) ZONE, IN THE LAKE HAVASU CITY AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
4, 1999, a public hearing was conducted to determine whether an Amendment to BOS Resolution No. 93-52,
setting forth a Zoning Use Permit, should be granted for the above-described property as requested by
Mohave County Planning and Zoning Department, Kingman, Arizona, and
WHEREAS, the language to be added has been bolded and double underlined. Language to be
deleted has been struck, and
WHEREAS, this property is located north of the Lake Havasu City Limits and west of State
Highway 95 on Goat Hill. The site is accessed from State Highway 95 via west on Goat Hill Road, a (four-
wheel drive) dirt trail to the northem portion of the property. The property is being used as a communication
facility and has several small buildings and several conm]unication towers on it. The terrain is rugged and
mountainous. The surrounding land uses consist of vacant land. There are no significant drainage patterns,
and
WHEREAS, the applicant request this Amendment to BOS Resolution No. 93-52, approving
a Zoning Use Permit to correct the legal description of the property. The legal description should
read "....on the SE¼ NE¼ of Section 32, Township 15 North, Range 20 West....", in addition,
Condition of Approval Number 3 is amended to allow a seventy (70) foot steel tower, and
WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area,
and
WHEREAS, a review of FEMA FIRM Panel #040058-2970B indicates the parcel described to be
in Zone A, in the Special Flood Hazaxd Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan.

c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WItEREAS, at the public hearing before the Mohave County Platming and Zoning Commission on
September 8, 1999, the Commission recommended APPROVAL for an Amendment to BOS Resolution No.
93-52, setting forth a Zoning Use Permit, subject to the following:
1. The legal description is changed to read, "....on the NW~A SE¼ NE¼ of Section 32,
Township 15 North, Range 20 West...."
2. Condition of Approval Number 3 is amended to read, "The steel tower shall not exceed
forty-rti~4~ ~ feet in height."
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 4, 1999, APPROVED this Amendment to BOS Resolution No. 93-52 setting forth a
Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined
herein.
