A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 36, RIO PALMAS, UNIT
2-B, IN SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A CHILD CARE GROUP
HOME IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE
VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October
4, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Paisley and Cheryl Yankolovich of Fort Mohave, Arizona, and
WHEREAS, this property is located east of State Highway 95, between Sterling Road and Camp
Mohave Road. The site is accessed from State Highway 95 via east on Valencia Road to the site, located
on the northwest comer of Valencia Road and Calle del Media. The property has a single-family residence
and two accessory buildings on it. The terrain is relatively flat, sloping slightly to the west toward the
Colorado River. The surrounding land uses consist of vacant lots and single-family residences. There are
no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a child care group home in an A-R
(Agricultural-Residential zone. The Mohave County General Plan designates this area as an Urban
Development Area, and
WItEREAS, a review of FEMA FIRM Panel #040058-2435D indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site, except the noted Special
Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
September 8, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a child care group home in an A-R (Agricultural-Residential)
zone and activities related thereto. The number of children allowed is limited to no greater
than 10 children for compensation in accordance with Mohave County Zoning Ordinance,
Section 27.T, (Child Care Facilities in Residential Zones Requirements).
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements)
must be completed and approved prior to approval ofpemfits and before establishing the use.
3. The applicant shall comply with all applicable provisions of the Arizona Department of
Economic Security (DES), Child Care Administration, Article 52: Certification and
Supervision of Family Child Care Home Providers.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, October 4, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County
Plmming and Zoning Commission and outlined herein.
