HomeMy WebLinkAbout99-376 INDEXED RESOLUTION NO. 99-376 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON PARCEL 11 AS SHOWN ON RECORD OF SURVEY BOOK 16, PAGE 98-98A, IN SECTION 23, TOWNSHIP 16 NORTH, RANGE 21 WEST, FOR A PLANT NURSERY IN A R-E (RESIDENTIAL-RECREATION) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. VqHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Benjmnin Serrano and Julie A. Harris of Lake Havasu City, Arizona, and WHEREAS, this property is located on both sides of County Highway 1 (Oatman-Topock Highway), approximately two miles south of the Golden Shores Community. The site is accessed directly from Coanty Highway 1 (Oatman-Topock Highway) both to the west and east. The property is vacant with gently rolling hills. The surrounding land uses consist of vacant land and a proposed recreational vehicle park to the southwest. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Pemfit for a plant nursery in a R-E (Residential- Recreation). The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2815C indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, Mohave Electric Cooperative (MEC) requests that their overhead power line crossing this property not be fenced in, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. RESOLUTION NO. 99-376 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 8, 1999, the Commission reconm~ended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a plant nursery in a R-E (Residential-Recreation) zone and activities related thereto. 2. The applicant shaI1 comply with all applicable provisions of the Mohave County Zoning Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. That the existing 100-foot roadway easement, known as County Highway 1 (Topock-Oatman Highway), shall be dedicated to Mohave County on behalf of the public and accepted by the Mohave County Board of Supervisors as road right-of-way. This dedication may be accomplished via a separate instrument. 4. Mohave Electric Cooperative (MEC) requests that their overhead power line crossing this property not be fenced in. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 6. If construction or use has not conmaenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted on September 17, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County outlined her~m.
