HomeMy WebLinkAbout99-388 INDEXED ~C CALL-~I~E~A~ ~tOFl(~tJE COUNTY BOARD RESOLUTION NO. 99-388 A RESOLUTION SETTING FORTH A REZONE OF PARCEL 66, LAZY Y-U RANCH, PHASE Il, IN SECTION 5, TOWNSHIP 20 NORTH, RANGE 16 WEST, FROM A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE TO A-R/ 5A AND A-R/7A (AGRICULTURAL-RESIDENTIAL/FIVE ACRE AND SEVEN ACRE MINIMUM LOT SIZE) ZONES, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 4, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Thomas J. and Leslie M. Criser, Fort Mohave, Arizona, and WHEREAS, this property is located southwest of Hualapal Mountain Road and southwest of Stagecoach Drive. The site is accessed from Hualapai Mountain Road via northwesterly and southwesterly on Lazy Y- U Drive to Stagecoach Drive, then northwesterly on Stagecoach Drive to Stagecoach Lane, then west and northwesterly on Stagecoach Lane to the south half of the property, located at the terminus of Stagecoach Lane. The property is vacant and the terrain is rolling hills sloping generally to the west. The surrounding land uses consist of vacant lots and one single family residence. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for development. The applicant proposes to divide the 38.00-gross-acre parcel into three 5-net-acre parcels and two 7-net-acre parcels. The Mohave County General Plan designates this area as Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2350C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area. Additional conunent: Do not obstruct the wash crossing the parcel, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant enviro~unental features affecting the site. RESOLUTION NO. 99-388 Page 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 8, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. These parcels will be rezoned A-IU5A and A-R/7A (Agricultural-Residential/Five and Seven Acre Minimum Lot Sizes) as shown in Exhibit "A". 2. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications is required. 3. That the Board of Supervisors accepts the granting of a 50-foot ingress/egress easement on proposed Parcel 66-D to allow access to proposed Parcels 66-A,C,E of the property, complete with a 45-foot minimum radius cul-de-sac bulb. NOTE: Parcel 66-B is accessed from Stagecoach Drive via south on a 60-foot right-of-way easement. In addition, Section 6.4-11 of the Mohave County Subdivision and Road Maintenance Regulations states, "Road and street grades shall be limited to a maximum of sixteen percent (16%) for paved roadways and a maximum of twelve percent (12%) for thoroughfares and gravel roadways." 4. The eight feet adjoining to the proposed 50-foot ingress/egress shall be granted to the public as a Public Utilities Easement (PUE). 5. The grantings required by the Rezone Resolution shall be shown on the Parcel Plat. 6. The roadway easement centerline will be monumented beneath the bladed road surface at all easement angle points and coinciding parcel comers. 7. Each parcel shall meet or exceed its respective acreage exclusive of roadways. 8. Each parcel shall have legal access. 9. The applicable flood zone(s) shall be noted on the Parcel Plat. 10. The appropriate zoning, building, environmental, and floodplain permits be obtained prior to any development. These permits will not be issued until Parcel Plat recordation. NOTE: Due to the shallow bedrock, standard septic systems may not be acceptable to Environmental Health or ADEQ. Alternative waste treatment systems may be required for these lots. 11. The rezone shall not become effective until at least 30 days after final Board of Supervisors approval for the change in classification, as per ARS 11-829E. RESOLUTION NO. 99-388 Page 3 12. If the required parcel plat prepared in accordance with Article 3.16 of the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications and Details is not recorded within one year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public heating to grant an extension, determine compliance with the schedule for development, or cause the properly to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, September 15, 1999, and posted September 17, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 4, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
