HomeMy WebLinkAbout99-398 RESOLUTION NO. 99-398 A RESOLUTION OF THE MOHAVE COUNTY BOARD OF SUPERVISORS ADOPTING THE AGGREGATE AMOUNT OF TWENTY-FIVE THOUSAND DOLLARS ($25,000) AS THE LIMIT FOR USE OF SIMPLIFIED PURCHASING PROCEDURES, REVISING THE MOHAVE COUNTY PURCHASING POLICY TO REFLECT THE TWENTY-FIVE THOUSAND DOLLAR ($25,000) LIMIT, AND AUTHORIZING AND DIRECTING THE COUNTY PURCHASING MANAGER TO REVISE THE SIMPLIFIED PURCHASING PROCEDURES SET FORTH IN THE MOHAVE COUNTY PURCHASING REGULATIONS TO ACCOMMODATE THE CHANGE TO THE TWENTY-FIVE THOUSAND DOLLAR ($25,000) LIMIT. WHEREAS, A.R.S. § 41-2535'exempts from the sealed competitive bidding process any State procurement which does not exceed the aggregate dollar amount of twenty-five thousand dollars ($25,000) and any State procurement involving construction which does not exceed the aggregate dollar amount of one hundred thousand dollars ($100,000); and WHEREAS, A.R.S. § 41-2501(C) provides that counties and other political subdivisions and local public agencies of the State may adopt all or any part of the State procurement code and regulations thereunder; and WHEREAS, A.R.S. § 11-254.01, relating to county purchasing procedures, was revised during the last legislative session to, among other things: a. Specifically authorize county boards of supervisors to adopt, in accordance with A.R.S. § 41-2501(C), the State of Arizona's higher aggregate dollar limits set forth in A.R.S. § 41-2535 as the limits under ;vhich such counties need not use a sealed competitive bidding process for purchases of supplies, material, equipment, and contractual services, excluding professional services, which may continue to be procured pursuant to written policies developed by the counties, ~vithout regard to an aggregate dollar limitation; and b. Require counties, whose boards of supervisors adopt the State limits, to develop purchasing procedures that comply with the uniform accounting system prescribed by the State Auditor General under A.R.S. § 41-1279.21 for purchases that fall under the new, higher limits ("Simplified Purchasing Procedures"); and WHEREAS, the Mohave County Board of Supervisors believes that increasing the aggregate dollar limit from ten thousand dollars ($10,000) to twenty-five thousand dollars ($25,000) for purchases of supplies, material, equipment, and contractual services, excluding professional services, that can be made using the Simplified Purchasing Procedures will streamline the procurement function in Mohave County, increase the County's efficiency and timeliness in securing such commodities and services, and permit the County to react more quickly as needs arise; thereby, improving the level of service to the citizens of the County; and WHEREAS, the Mohave County Board of Supervisors finds that the public interest and welfare will be furthered by the action taken hereby; NOW THEREFORE BE IT RESOLVED THAT THE MOHAVE COUNTY BOARD OF SUPERVISORS HEREBY: 1. In accordance with A.R.S. §§ 11-254.01 (A&C) and 41-2501(C), adopts the aggregate amount of twenty-five thousand dollars ($25,000) set forth in A.R.S. § 41-2535(A) as the limit for determining, as set forth below, whether a sealed competitive bidding process or the County's Simplified Purchasing Procedures must be used for a procurement of supplies, material, equipment, and contractual services, excluding professional services: a. A sealed competitive bidding process shall be used for all purchases of supplies, materials, equipment and contractual services, excluding professional services, made by the County having an estimated aggregate cost in excess of twenty-five thousand dollars ($25,000); b. The County's Simplified Purchasing Procedures, adopted pursuant to A.R.S. § 11-254.01(C), shall be used for purchases of supplies, materials, equipment and contractual services, excluding professional services, made by the County having an estimated aggregate cost of twenty-five thousand dollars ($25,000) or less; c. Provided, further, that nothing in this Resolution shall preclude the County from using different procurement procedures then set forth in sub-sections 1 (a) and 1 (b) above to the extent such procedures are otherwise authorized by statute and/or the Mohave County Purchasing Policy, including, but not limited to, procurement procedures used in emergency and sole source situations. 2 2. Revises the dollar limit in Section 3.6 of the Mohave County Purchasing Policy from $10,000 to $25,000, as set forth below: 3.6 PROCUREMENTS NOT EXCEEDING AN AGGP,~EGATE AMOUNT OF TWENTY-FIVE THOUSAND DOLLARS Any procurement which does not exceed an aggregate amount of twenty- five thousand dollars may be made in accordance with procedures promulgated by the Manager, except that the procurements shall be made with such competition as is practicable under the circumstances. Procurement requirements shall not be artificially divided or fragmented so as to constitute a purchase under this section and to circumvent the source selection procedures required by 3.3 and 3.4. 3. Authorizes and directs the County Purchasing Manager to revise the Simplified Purchasing Procedures set forth in the Mohave County Purchasing Regulations in accordance with A.R.S. § 11-254.01 and this Resolution to accommodate the change to the t~venty-five thousand dollar ($25,000) limit.
