RE(:OF~DS .lOAN HC C~LL.~ ME)HAVE ~IOHAVE COUNTY BOARO OF' SUPERVZSORS RECOROIN~ FEE RESOLUTION NO. 99-422 A RESOLUTION SETTING FORTH AN ACCEPTANCE OF AS-BUILT IMPROVEMENT PLANS AND A RELEASE OF ALL REMAINING ASSURANCES FOR THAT PORTION OF LOS LAGOS, TRACT 4096-A, A SUBDIVISION OF A PORTION OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, NOT INCLUDED IN LOS LAGOS COUNTRY CLUB VILLAS AND ESTATES, TRACT 4166, A PROPOSED SUBDIVISION OF A PORTION OF SECTION 1, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether as-built improvement plans should be accepted and whether all remaining assurances for the above-described subdivision should be released. The owner and developer of this tract is Desert Lakes Development/Los Lagos Development, Fort Mojave, Arizona. The new project engineer is Ludwig Engineering, San Bemardino, California, and WHEREAS, the property is located approximately four and one-half miles south of Bullhead City. The site is accessed via State Highway 95, then east one mile on Lipan Boulevard to the subdivision, and WHEREAS, the Final Plat for Los Lagos, Tract 4096-A, was recorded on August 27, 1991. The assurance for the completion of improvements for this subdivision was combined with the assurances for two other subdivisions: Desert Lakes Golf Course and Estates, Tract 4076-C, recorded May 23, 1990; and Desert Lakes Estates, Tract 4152-A, recorded November 28, 1995, and WHEREAS, the first separate Extension of Time for the combined assurance for Tracts 4076-C, 4096-A, and 4152-A was granted by the Board of Supervisors on April 7, 1997, per BOS Resolution No. 97-99, with that extension expiring December 20, 1997. Prior to that time the extension was considered automatic as a part of the Preliminary Plan extension for those tracts requiring such extension. The second extension was granted on February 2, 1998, per BOS Resolution No. 98-51, expiring December 20, 1998. The assurances for Tract 4076-C were fully released on June 1, 1998, per BOS Resolution No. 98-202. The third extension (for the assurances for the outstanding improvements for Tract 4096-A and Tract 4152-A) was granted on November 2, 1998, per BOS Resolution No. 98-400. That extension split the period of assurance approval so that the assurance for Tract 4096-A would expire on April 20, 1999, and the assurance for Tract 4152-A expires on December 20, 1999. A fourth Extension of Time for the Tract 4096-A assurance was granted on May 10, 1999, per BOS Resolution No. 99-165, expiring on August 20, 1999. Article 5.4 of the Mohave County Subdivision Regulations states: "The duration of the performance bond or other assurance shall be for one (1) year from the date of recording. Extensions of time in one (1) year increments may be granted by the Board of Supervisors by showing just cause.", and F?~GE 2. rZ)F' '~ RESOLUTION NO. 99-422 Page 2 WHEREAS, prior to August 20, 1999, the developers of Tract 4096-A submitted a separate assurance to Mohave County in the amount of $102,500.00 to cover the remaining improvements in Tract 4096-A (apparently mxly drainage facilities, all of which are now located within the same developer's new proposed subdivision, Los Lagos Country Club Villas and Estates, Tract 4166). The posting of this separate assurance allows Mohave County to process this final assurance release for the account held previously for Tract 4096-A. Those remaining i~nprovements formerly required of Tract 4096-A are now required to be completed with Tract 4166-A, and WHEREAS, the County Engineer recommends acceptance of the as-built improvement plans submitted for this project and the release of all remaining assurances for Tract 4096-A (an amount totalling $744,756.18), and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes amd the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors at their regular meeting on Monday, November 1, 1999, APPROVED this acceptance of the As-Built Improvement Plans and the release of all remaining assurances for that portion of Los Lagos, Tract 4096-A, as described herein, and as recommended by the Mohave County Planning aud Zoning Corn aission and outlined herein.
