RECORDS OF MOHAgE COUNTY JOAN HC CALL.~ HOHAVE {:OU~TY ...... 4.F F'A~E riOHAVE C:OUHTY BOARD OF RECORDING FEE 0.00 RESOLUTION NO. 99-423 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF THE WILLOWS AT CIMARRON LAKE, UNIT II, TRACT 4130, BEING A SUBDIVISION OF A PORTION OF SECTION 23, TOWNSHIP 18 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by the owner/developer, Everett L. King, BKCL, LLC, Phoenix, Arizona. The project engineer is A-N West, Inc., Bullhead City, Arizona, and WHEREAS, the property is located approximately seven and one-half miles south of Bullhead City. The land is accessed via State Highway 95, then east approximately one-half mile along Cimarron Boulevard and south to the site, and WHEREAS, the Preliminary Plan depicts 45.8 acres subdivided into 136 single-£anaily residential lots, and four park/open space parcels. The minimum residential lot size is 6,500 square feet, and WHEREAS, the developer has indicated in a letter dated September 21, 1999, that an Extension of Time is being requested, as the developer needs more time to process and record the Final Plats for the subdivision. The developer refers in his letter to a corrected Final Plat submittal for Tract 4130-A, that was to have been mailed in August 1999. Mohave County did not receive such a submittal, and WHEREAS, the Preliminary Plata for this tract was approved by the Mohave County Board of Supervisors on December 5, 1994, per BOS Resolution No. 94-420. The first and second Extensions of Time of the conditional approval of the Preliminary Plan for this tract were granted on January 5, 1998, per BOS Resolution No. 98-4. The third extension was granted on November 2, 1998, per BOS Resolution No. 98-399, with project approval automatically expiring on December 5, 1999. Subdivision Regulations, Article 3.10-1, states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments o£ one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated.", and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development, including without limitation, roadways and easements, including utilities and drainage, will be reviewed, and has recommended that any required changes or modifications will be the responsibility of the developer, and RESOLUTION NO. 99-423 Page 2 WHEREAS, this action, if approved, will be the fourth Extension of Time for the conditional Preliminary Plan approval of this proposed subdivision, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request does comply with the Extension of Time Policy due to the following: 1) The Final Plat for the first phase of this subdivision has been occasionally processed since the last extension for this project. As no Final Plats have yet been recorded for this project, additional staff`recommendations of approval for further extensions will depend largely on the recordation of the Final Plat for Phase A, and active processing of the other phases of the tract. c. The developer has completed most of the subdivision improvements for Tract 4130-A, but now proposes the use of a financial assurance for the remainder of outstanding improvements for that phase. The form of the assurance proposed by the developer was not approved by the County Attorney's Office. The developer has not submitted another fom~ of assurance for county review. d. A corrected Final Plat submittal, including necessary support'rog documentation, needs to be submitted to the Planning and Zoning Department for review, to address comments of the previous plat review· WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1999, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 94-420, 98-4, and 98-399· 2. This Extension of Time will be in effect until December 5, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
