L~ MOHAVE COUNTY RECOROEP tl/02t1999 )~.5..~ RAGE 1 MOHAVE COUNTY BOARD OF SUPERV]]S(]R% RECORDING FEE RESOLUTION NO. 99-424 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED PRELIMINARY SUBDIVISION PLAN OF DESERT LAKES GOLF COURSE AND ESTATES, UNIT H, TRACT 4159, BEING A SUBDIVISION OF LOT 4, MOHAVE MESA ACRES, TRACT 1020, IN SECTION 35, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether approval should be granted for an Extension of Time as requested by the developer, Angelo Rinaldi, Desert Lakes Development, Fort Mohave, Arizona. The previous project engineer was Stadler Consulting Engineers, Inc., Phoenix, Arizona, and WHEREAS, the property is located approximately three miles south of Bullhead City. The land is accessed via State Highway 95, then east one-half mile on Joy Lane, then south one-quarter mile along and east of Tableau Drive to the site, and WHEREAS, the Preliminary Plan depicts 2.18 acres subdivided into six single-family residential lots. An existing home is located on the one, acre-sized lot in the tract. The remaining five lots all slightly exceed 7,000 square feet in size, mad WHEREAS, the developer has indicated in a letter dated September 21, 1999, that an Extension of Time is being requested, as the developer needs more time to process and record the Final Plat for the subdivision, mad VqHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of Supervisors on December 2, 1996, per BOS Resolution No. 96-404. The first Extension of Time of the conditional approval of the Preliminary Plan for this tract were granted on November 2, 1998, per BOS Resolution No. 98-398, with project approval automatically expiring on December 2, 2000. Subdivision Regulations, Article 3.10-1, states: "Upon application to the Commission and prior to the expiration of the time limit, extensions in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be terminated." and WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any additional submittals of this project for processing, the adequacy of the drainage and compatibility of this proposed subdivision with surrounding development, including without limitation, roadways and easements, including utilities and drainage, will be reviewed, and has recommended that any required changes or modifications will be the responsibility of the developer, and RESOLUTION NO. 99-424 Page 2 WHEREAS, this subdivision is minimal in scope, including only six lots, and staff is aware of no legitimate reason for this simple subdivision to be stalled as it appears to be. Staff is recommending that this second extension request be approved, despite the lack of m~y processing activity, as other subdivisions lacking progress have been granted the sanre leniency, and WHEREAS, this action, if approved, will be the second Extension of Time for the conditional Preliminary Plan approval of this proposed subdivision, and WHEREAS, the following are Findings of Fact for the above captioned item: a. All notices have been advertised and posted according to regulations. b. This request does not comply with the Extension of Time Policy due to the following: 1) The Final Plat for this subdivision has not actively processed since the last Extension of Time for this project, and 2) the developer has not demonstrated the completion of any subdivision improvements, or shown that any progress has otherwise been made which would lead to the recordation of this subdivision. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1999, the Commission recommended APPROVAL of an Extension of Time for the Preliminary Plan subject to the following conditions: 1. Compliance with all conditions of BOS Resolution Nos. 96-404 and 98-398. 2. Unless the Final Plat for this tract is recorded in the coming year, Planning staff will recommend denial of any additional Extensions of Time for this Preliminary Plan. 3. This Extension of Time will be in effect until December 2, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting vember 1, 1999, APPROVED on this Extension of/Time as recommended by the Mohave Commission and ,utlined herein.// M~ }HAV Y BOARD OF SUPERVISORS // Buster D.
