OF '2 MOHAVE COUNTY BOARO OE SUPERV]:SOPS RECORDING FEE 0.00 RESOLUTION NO. 99-425 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE ASSURANCES FOR THE COMPLETION OF IMPROVEMENTS FOR DESERT LAKES ESTATES, TRACT 4152-A, BEING A SUBDMSION OF A PORTION OF SECTION 36, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave Comity Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether an Extension of Time should be granted for the assurances for the completion of all improvements for the above-referenced subdivision. Angelo Rinaldi, Desert Lakes Development, Fort Mohave, Arizona, is one of the developers of this project. Stadler Consulting Engineers, Inc. of Phoenix, Arizona, was the previous project engineer. Phoenix Engineering took over the project, followed by Robberson Engineering. William T. Miller Engineering, Inc., Lake Havasu City, Arizona, is the new engineer of record for the unrecorded phases of Tract 4152, and WHEREAS, the Final Plat of Desert Lakes Estates, Tract 4152-A, was recorded on November 28, 1995. The assurance for this subdivision was previously tied to the assurance for two other subdivisions, Los Lagos, Tract 4096-A, and Desert Lakes Golf Course and Estates, Tract 4076-C, projects long recorded for which improvements have recently been completed. A final assurance release for Tract 4076-C was approved by the Board of Supervisors on June 1, 1998, per BOS Resolution No. 98-202. The final assurance release for Tract 4096-A has been tentatively scheduled for consideration by the Planning and Zoning Commission at their meeting on October 13, 1999, and WHEREAS, for a number of years the annual extension of several subdivision assurances was implied as part of the Preliminary Plan extensions for those projects. In December 1996, assurance extensions began to be processed separately from Preliminary Plan extensions for those subdivisions which had not previously been separately processed. The first explicit Extension of Time for the assurance fund for the above-referenced subdivisions was granted by the Board of Supervisors on April 7, 1997, per BOS Resolution No. 97-99. The second extension was granted on February 2, 1998, per BOS Resolution No. 98- 51. The third extension was granted on November 2, 1998, per BOS Resolution No. 98-400. The third extension split the period of assurance approval such that the assurance for Tract 4096-A would expire on April 20, 1999, and the assurance for Tract 4152-A expires December 20, 1999. A fourth extension was processed separately for the Tract 4096-A assurance on May 10, 1999, per BOS Resolution No. 99-165. That extension did not cover the assurance for Tract 4152-A, as extension processing for the two projects was divided beginning with that action. Article 5.4 of the Mohave County Subdivision Regulations states: "The duration of the performance bond or other assurance shall be for one (1) year from the date of recording. Extensions of Time in one (1) year increments may be granted by the Board of Supervisors by showing just cause.", and RESOLUTION NO. 99-425 Page 2 WHEREAS, since the last extension for this assurance, a project engineer has submitted as-built improvement plans demonstrating some progress toward the completion of the subdivision improvements. The Public Works Department advises that significant improvements remain to be completed for Tract 4152- A. A Final Plat has been submitted and is in review for Tract 4152-B, and WHEREAS, the outstanding assurance balance as of the latest partial release dated December 4, 1996, is $185,982.20, and WHEREAS, the Public Works Depamnent has commented that the subdivision improvements shall be completed in accordance with the approved improvement plans for this subdivision, and WHEREAS, this action, if approved, will be the fourth Extension of Time for the assurance for Tract 4152-A, and WHEREAS, at the public hearing before the Mohave County Plamfing and Zoning Conunission on October 13, 1999, the Commission recommended APPROVAL of the Extension of Time for the assurances for the completion of subdivision improvements for Desert Lakes Estates, Tract 4152-A, subject to the following: 1. This extension of time will be in effect until December 20, 2000. WHEREAS, the advertising requirements have been met throughout this subdivision process as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 1, 1999, APPROVED this Extension of Time for the assurances for the completion of subdivision improvements for Desert Lakes Estates, Tract 4152/~A, as recommended by the Mohave antv Plmming and Zoning Commission and o¢l, lined herein. ,?~L:~'~'~:,??,..
