RESOLUTION NO. 99-426
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT
ON THE EAST 590 FEET OF THE WEST 990 FEET OF THE NORTH 220 FEET OF THE SW¼
NE¼ OF SECTION 14, EXCLUDING THE NORTH 35 FEET AND THE EAST 35 FEET, IN
TOWNSHIP 18 NORTH, RANGE 22 WEST, FOR AN EQUESTRIAN ACTIVITY ARENA IN AN
A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA,
MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
1, 1999, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use
Permit should be granted for the above-described property as requested by Todd R. and Joan M. Shumway
of Bullhead City, Arizona, and
WHEREAS, this property is located east of State Highway 95 between Jerome Avenue and Hulet
Avenue. The site is accessed from State Highway 95 via east on Jerome Avenue to Calle del Media, then
south on Calle del Media approximately one-quarter mile to an unnamed road, then east on this unnamed
road approximately 400 feet to the property, located on the south side of the road. The property has a single-
family residence and an equestrian arena on it. The property is relatively flat, sloping slightly to the west
toward the Colorado River. The surrounding land uses consist of vacant lots and a few scattered single-
family residences. There are no significant drainage patterns. The Mohave County General Plan designates
this area as an Urban Development Area, and
WHEREAS, this Zoning Use Permit was recommended for DENIAL by the Plmming and Zoning
Commission on December 10, 1997 but was conditionally approved by the Mohave County Board of
Supervisors on February 2, 1998 per BOS Resolution No. 98-17. On Jm~e 9, 1999, again the Planning and
Zoning Conunission recommended DENIAL for the first request for an Extension of Time, but on July 9,
1999, the Mohave County Board of Supervisors extended this Zoning Use Permit for only ninety days to
October 9, 1999 via BOS Resolution No. 99-238, and
WHEREAS, the property owner has accomplished the following conditions of approval as required
by BOS Resolution No. 98-17:
a. Condition Number 2: The site plan prepared in accordance with Section 27.P (Site
Plan Requirements) has been submitted and is in the third review.
b. Condition Nun~ber 7: The septic permit for the handicapped restroom and the snack
bar has been applied for but the system has not been installed; awaiting approval of
the site plan.

c. Condition Number 9: The driveways and roadways have been stabilized in an
acceptable manner to the Mohave County Public Works Department.
WHEREAS, this will be the second Extension of Time for this property, and
WHEREAS, a review of FEMA FIRM Panel #040058-2605C indicates the parcel described to be
in Zone B, not in the FEMA Special Flood Hazard Area, and
WltEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
f. This request complies with the Extension of Time Policy.
WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
October 13, 1999, the Contmission recommended APPROVAL for an Extension of Time for a Zoning Use
Permit subject to the following:
1. Compliance with the conditions of BOS Resolution No. 98-17.
2. This Extension of Time will be in effect until February 2, 2000.
3. This will be the last Extension of Time unless significant progress is made to complete the
conditions of BOS Resolution No. 98-17.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on 1, 1999, APPROVED this Extension of Tim~/4"~' a Zoning Use Pemfit as
