HomeMy WebLinkAbout99-427 OFFICIAL RECORDS OF MOHAVE COUNTY -,~F.~I , , MOHAVE COUNTY JOAN MC CALL~.~ 11/02/1779 03..5P PAGE 1 OF MOHAVE COUNTY 80ARO ~F RECORDING FEE 0.00 RESOLUTION NO. 99-427 A RESOLUTION SETTING FORTH A REZONE OF PARCEL "B" AS SHOWN ON PARCEL PLATS BOOK 6, PAGE 95, IN THE E½ SW~A OF SECTION 23, TO BE SUBDIVIDED AND KNOWN AS SANTA EVINITA, TRACT 4167, IN TOWNSHIP 19 NORTH, RANGE 22 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL) ZONE TO R-1 (SINGLE FAMILY RESIDENTIAL) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Counsel Corporation, being represented by John K. Hoover of Newport Beach, California, and WHEREAS, this property is located east of State Highway 95, between Camp Mohave Road and E1 Rodeo Road. The site is accessed from State Highway 95 via east on E1 Rodeo Road to Calle del Media, then north on Calle del Media approximately 300 feet to the site, located on the west side of Calle del Media. The property is vacant and relatively flat, sloping slightly to the west toward the Colorado River. The surrounding land uses consist of vacant land, several single-family residential subdivisions and general commercial businesses to the west along State Highway 95. There are no significant drainage patterns noted, and WHEREAS, the applicant requests this zone change to allow for developing a 74-1ot subdivision to be known and subdivided as SANTA EVINITA, Tract 4167, and to be zoned R-1 (Single Fanfily Residential). The applicant proposes to divide the 13.09-acre parcel into 74 lots ranging in size from 6,000 square feet to 10,000 square feet. The Mohave County General Plan designates this area as an Urban Development Area. The South Mohave Valley Area Plan designates this property as Single-Family Residential (SFR), and WHEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. The proposed action and the effect complies with the Mohave County General Plan. c. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. Them are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: 1. SANTA EVINITA, Tract 4167, will be rezoned R-1 (Single Fanfily Residential). 2. The rezone will be effective upon the recordation of the Final Plat of SANTA EVINITA, Tract 4167, or for each phase of SANTA EVINITA, Tract 4167, if the subdivision is phased; and the rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 3. The lot size minimum will be based on the size of the lots recorded on the Final Plat with no further lot splits. 4. The appropriate zoning, building, environmental and floodplain permits will be obtained prior to construction. 5. The applicant shall comply with all applicable provisions of the Mohave Comity Zoning Regulations. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
