RESOLUTION NO. 99-429
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 5, BLOCK 2,
MOUNTAIN VIEW RANCHES, TRACT 4003-C, IN SECTION 5, TOWNSHIP 18 NORTH, RANGE
21 WEST, FOR A RESIDENCE IN A C-MO/5A (COMMERCIAL-MANUFACTURING/OPEN LOT
STORAGE/FIVE ACRE MINIMUM LOT SIZE) ZONE, IN THE SOUTH MOHAVE VALLEY
AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
1, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Gall R. and Joanne V. Bart of Mohave Valley, Arizona, and
WHEREAS, this property is located east of State Highway 95, on the south side of Boundary Cone
Road. The site is accessed from State Highway 95 via east on Boundary Cone Road approximately three
and one-quarter (3¼) miles to the site, located on the southeast comer of Boundary Cone Road and Bradley
Drive. The property has a welding shop and a single-family residence on it. The surrounding land uses
consist of vacant lots, several commercial businesses along Boundary Cone Road, a recreational vehicle park
and a few widely scattered single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a residence for the applicant's
daughter to live as a caregiver, as the applicants are elderly and under medical care. The Mohave County
General Plan designates this area as an Urban Development Area, and
VOtEREAS, a review of FEMA FIRM Panel #040058-2445C indicates the parcel described to be
in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.
e. The site has legal access.
f. There are no significant environmental features affecting the site.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Coaunission on
October 13, 1999, the Commission reconunended APPROVAL for a Zoning Use Permit subject to the
following:
1. This Zoning Use Permit is for a residence in a C-MO/5A (Commemial-Manufacturing/Open
Lot Storage/Five Acre Minimum Lot Size) zone and activities related thereto.
2. The applicant shall comply with ali applicable provisions of the Mohave County Zoning
Regulations.
3. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
4. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 1, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
