WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Robert D. and Bonnie S. Flores of Golden Valley, Arizona, and WHEREAS, this property is located south of State Highway 68, between Verde Road and Adobe Road. The site is accessed from State Highway 68 via south on Verde Road to the site, located on the east side of Verde Road, approximately 200 feet north of Shipp Drive. The property has a single-family residence and an accessory building on it. The terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of single-family residences and vacant lots. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow a secondary residence in an A- R/10A (Agricultural-Residential/Ten Acre Minimum Lot Size) zone for Mrs. Flores's parents. The applicants propose to convert the existing garage into living space. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2325B indicates the parcel described to be in Zone A, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant enviromnental features affecting the site. RESOLUTION NO. 99-432 Page 2 WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on October 13, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). As per the Mohave County Zoning Regulations, the secondary residence will be used for non- paying guests and relatives ONLY. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan prepared in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of heating was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 1, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and .-.
