HomeMy WebLinkAbout99-435 OFFICIAL RE(:OROS OF MOHAVE C:OUflT~ JOAN MC (~AL[, MOHAVE 11102/1999 I)3:57P PAGE f'IOHAVE COUNTY BOARD OF RECORDING FEE 0.03 RESOLUTION NO. 99-435 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON GOVERNMENT LOT 4, IN SECTION 6, TOWNSHIP 25 NORTH, RANGE 18 WEST, FOR A WATER STORAGE TANK IN AN A-R/36A (AGRICULTURAL-RESIDENTIAL/THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WItEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to detemtine whether an Extension of Time for a Zoning Use Permit should be granted for the above-described property as requested by Kent E. Norcross, P.E., Sunrise Engineering, Inc., of Mesa, Arizona, representing the Mt. Tipton Water Company of Dolan Springs, Arizona, and WHEREAS, this property is located east of Pierce Ferry Road, between Eleventh Street and Ninth Street. The site is accessed fi'om Pierce Ferry Road via east on Eleventh Street approximately one and one- quarter (1%) miles to the site, located on the south side of Eleventh Street on land managed by the Bureau of Land Management (BLM). The property has an existing water tank on it and the terrain slopes to the northeast. The surrounding land uses consist of vacant land and a few scattered single-family residences to the west. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area and Dolan Springs is an Outlying Community, and WHEREAS, this Zoning Use Permit was couditionally approved by the Mohave County Board of Supervisors on April 6, 1998 per BOS Resolution No. 98-139, and WHEREAS, the applicant requested in a letter dated August 9, 1999, that the Zoning Use Permit be extended for one year. The letter stated that the water company was delayed due to problems in finalizing the project funding and it is anticipated the funding will be in place by mid-September 1999 and is expecting to start construction in November 1999, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 98-139, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-1800C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and BK 3402 F'G 1~ , EE=9, ]o._.l,-, RESOLUTION NO. 99-435 Page 2 WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other like land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. g. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1999, the Commission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: 1. Compliance with the conditions of BOS Resolution No. 98-139. 2. This Extension of Time will be in effect until April 6, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 1, 1999, APPROVED this Extension of Time for a Zoning Use Permit as · the Mohave County Planning and Z~ning Conmfission and outlined herein. ~' i~!~i,~ 3~O& ~OUNTY ~0//ARD OF SUPERVISORS
