J.~.57P PAGE 1 ~iOHAVE COUNTY BOARD OF ~: ~:F RECORDING FEE 0.00 RESOLUTION NO. 99-436 A RESOLUTION SETTING FORTH AN EXTENSION OF TIME FOR A ZONING USE PERMIT ON A PORTION OF PARCEL 28, CEDAR HILLS RANCHES, UNIT 2, IN SECTION 31, TOWNSHIP 21 NORTH, RANGE 14 WEST, FOR A SECONDARY RESIDENCE IN AN A-R/10A (AGRICULTURAL-RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November 1, 1999, a public hearing was conducted to determine whether an Extension of Time for a Zoning Use Permit shou2d be granted for the above-described property as requested by Frank E. and Charlene D. Proa of Kingman, Arizona, and WHEREAS, this property is located south of Interstate 40, between Blake Ranch Road and Arabian Drive. The site is accessed from Interstate 40 via southwest at the Blake Ranch Road exit to the site, located on the southeast side approximately one and one-half (11/2) miles from Interstate 40. The property has a single-family residence along with several accessory buildings on it, and the terrain is rolling hills, sloping generally to the southeast. The surrounding land uses consist of vacant lots and a few scattered single- family residences. There are no significant drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, this Zoning Use Permit was conditionally approved by the Mohave County Board of Supervisors on September 8, 1998 per BOS Resolution No. 98-331, and WHEREAS, the applicant requested in a letter dated August 24, 1999, that the Zoning Use Permit be extended for one year. The letter stated that due to a delay in the sale of property owned by Rosemary Proa, the mother-in-law, the conditions have not been met, and WHEREAS, the property owner has not accomplished any of the conditions of approval as required by BOS Resolution No. 98-331, and WHEREAS, this will be the first Extension of Time for this property, and WHEREAS, a review of FEMA FIRM Panel #040058-2375B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: BI4 7,4-2 F'fi 20 lEE ..... 65 RESOLUTION NO. 99-436 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the sun'ounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. f. This request complies with the Extension of Time Policy. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on October 13, 1999, the Conunission recommended APPROVAL for an Extension of Time for a Zoning Use Permit subject to the following: 1. Compliance with the conditions of BOS Resolution No. 98-331. 2. This Extension of Time will be in effect until September 8, 2000. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, November 1, 1999, APPROVED this Extension of Time for a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
