RESOLUTION NO. 99-440
A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 92-69. 93-
167, 94-353, 94-354, 96-92 AND 96-382 WHICH APPROVED THE ZONING USE PERMIT AND
THE EXTENSION OF TIME FOR THE ZONING USE PERMIT, THE REZONE, THE SPECIFIC
USE PERMIT AND THE EXTENSIONS OF TIME FOR THE SPECIFIC USE PERMIT FOR A
PORTION OF PARCEL 5, FORT ROCK RANCHES, UNIT I-B, IN SECTIONS 7 AND 8,
TOWNSHIP 20 NORTH, RANGE 11 WEST, IN THE MOHAVE COUNTY GENERAL AREA,
MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on November
1, 1999, a public hearing was conducted to determine whether approval should be granted for the Rescission
of the Resolutions for the Zoning Use Permit and the Extension of Time for the Zoning Use Permit, the
Rezone, the Specific Use Permit and the Extensions of Time for the Specific Use Permit for the above-
described property as requested by the Mohave County Planning and Zoning Department. The property
owners of record are Knight Creek Land Company, Inc., of Lake Havasu City, Arizona and Aquarius
Holdings, Inc., of Tucson, Arizona, and
WHEREAS, tiffs property is located south of Interstate 40, approximately 30 miles east of the City
of Kingman. The site is accessed from Interstate 40 via the Willows Ranch Road Interchange, then south
and west along Willows Ranch Road which runs parallel with Interstate 40 approximately one and seven-
tenths (1.7) miles to Knight Creek Road, then south and west on Knight Creek Road approximately five and
six-tenths (5.6) miles, passing through a gate located at approximately three and one-half (3.5) miles, to the
site. The property is part of a 40-acre parcel containing a home and a dirt landing strip; the 3-acre parcel
reserved for the proposed bottling plant is vacant. There are no significant drainage patterns, and
WHEREAS, this property was conditionally approved for a Zoning Use Permit for the establishment
of a water bottling facility in an A-R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size)
zone by the Mohave County Board of Supervisors on March 9, 1992, via BOS Resolution No. 92-69. It was
first extended on June 7, 1993, with BOS Resolution No. 93-167. During staff review of the Extension of
Time for the Zoning Use Permit it was discovered that bottling facilities are not permitted in an A-R
(Agricultural-Residential) zone with a Zoning Use Permit. It was conditionally approved for a Rezone to
M (General Manufacturing) by the Mohave County Board of Supervisors on October 4, 1994, via BOS
Resolution No. 94-353 and a Specific Use Permit for the establishment of a water bottling facility in an M
(General Manufacturing) zone with BOS Resolution No. 94-354. The Specific Use Pem~it was first
extended on March 1996, with BOS Resolution No. 96-62. It was extended the second time with BOS
Resolution No. 96-382 on November 4, 1996. There have not been any more requests for Extensions of
Time. A letter was sent informing the property owner that it would be scheduled for rescission. The
Mohave County General Plan designates this area as a Rural Development Area, and

WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site has legal access.
d. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
October 13, 1999, the Commission recommended that BOS Resolution Nos. 92-69, 93-167, 94-353, 94-354,
96-92 and 96-382 be RESCINDED and that the zoning revert to A-R/36A (Agricultural-Residential/Thirty-
six Acre Minimum Lot Size).
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, October 13, 1999, and posted on October 15, 1999, as
required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, November 1, 1999, RESCINDED BOS Resolution Nos. 92-69, 93-167, 94-353, 94-354, 96-92
and 96-382 and REVERTED the zoning to A-R/36A (Agricultural-Resid/e~ttial/Thirty-six Acre Minimum
Lot Size), as recommended by the Mohave County Planning and Zonin~7ommission and outlined herein.
