WHEREAS, pursuant to A.R.S. §11-251.05 the Board of Supervisors has the
the authority t° adopt ordinances necessary and proper to carry out the duties,
responsibilities, and functions of the County, and
WHEREAS, the Board of Supervisors have determined that adoption of an
Ordinance regarding commercial parking on residential streets would be beneficial to the
residents of the County,
THEREFORE BE IT RESOLVED, adopting Ordinance No. 99-06 in the form
attached hereto.

Regarding Commercial Parking on Residential Streets: ~ICRORL~I~ J ~
1. Except as provided in subsection (2) no person shall park or leave standing
a commercial Vehicle On any street or portiOn of the road in a residential district as
defined herein.
2. This prohibition shall not apply to the parking or standing of a commercial
vehicle.
A) making pickups or deliveries fi:om or to any building or structure within
a residential district.
B) delivering materials to be used for construction or remodeling or repair
of any building or structure for Which a building permit has been obtained.
C) located on State or Federal highways or within the boundaries of an
incorporated city or town.
3. For purposes of this Section, the term "commercial vehicle" shall mean any
semi-tractor, semi-trailer or other tandem axle vehicle used for commerical purposes.
4. "Residential area" shall mean any property zoned residential either single
family, multiPle family or agricultural residential.
5. Prior to issuing a citation for which a civil sanction shall be imposed, the
operator of the vehicle will receive one notice of violation from the enforcement agency.
The notice shall read substantially as follows: "You are hereby noticed that you have

parked a commercial vehicle on a residential street in violation of county ordinances, such
violation can result in a fine up to an amount of $1,000."
