HomeMy WebLinkAbout99-449 RESOLUTION NO. 99-449 A RESOLUTION SETTING FORTH THE RESCISSION OF BOS RESOLUTION NOS. 97-27 AND 97-28 WHICH APPROVED THE REZONE AND THE ZONING USE PERMIT FOR A PORTION OF THE SE¼ SE¼ SW¼ AND THE SW¼ SW¼ SE¼ OF SECTION 16, IN TOWNSHIP 39 NORTH, RANGE 16 WEST, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave Coanty Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether approval should be granted for the Rescission of the Resolutions for the Rezone and the Zoning Use Permit for the above-described property, as requested by the Mohave County Planning and Zoning Department. The property owners of record are Larry S. and Kathryn D. Lexes of Mesquite, Nevada and Jacob R. Youngman of Denver, Colorado, and WHEREAS, this property is located south of Interstate 15 and south of Mesquite, Nevada in the Scenic area of Mohave County. The site is accessed from Mesquite, Nevada via east on Elbow Canyon Road to the site, located on the north side approximately one-half(½) mile west of Littlefield Drive. The western half of this property has a single-family residence on it and the eastem half is vacant. There are no significant drainage patterns, and WHEREAS, this property was conditionally approved for a rezone to C-2/5A (General Commercial/Five Acre Minimum Lot Size) and A-R/7A (Agricultural-Residential/Seven Acre Minimum Lot Size) zones by the Mohave Coturty Board of Supervisors on February 3, 1997, via BOS Resolution No. 97-27. A Zoning Use Permit for a recreational vehicle park was conditionally approved on the A-R/7A (Agricultural-Residential/Seven Acm Minimum Lot Size) zoned portion of this property with BOS Resolution No. 97-28 on February 3, 1997. These actions were requested by David C. Hellberg of Boulder City, Nevada, representing the property owner. The resolutions were never extended and the property has been sold by the property owner, Rein and Hannelore Univer, to two different buyers. The SE1/4 SE1/4 SW¼ of Section 16 was sold to Larry S. and Kathryn D. Lexes of Mesquite, Nevada and the SW¼ SW¼ SE¼ of Section 16 was sold to Jacob R. Youngman of Denver, Colorado. The zoning no longer matches the property. A letter has been sent to the owners notifying them that their approval of their rezoning and Zoning Use Permit has expired and that they would be scheduled for rescission. The Mohave County General Plan designates this area as air Urban Development Area and the Virgin River Communities Area Plan designates this area as HDR (High Density Residential, 12 to 16 dwelling units per acre), and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. RESOLUTION NO. 99-449 Page 2 b. The proposed action and effect complies with the Mohave County General Plan and the Virgin River Communities Area Plan. c. The site has legal access. d. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Plmming and Zoning Commission on November 10, 1999, the Commission recommended that BOS Resolution Nos. 97-27 and 97-28 be RESCINDED and that the zoning revert to A-R (Agricultural-Residential). WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, RESCINDED BOS Resolution Nos. 97-27 and 97-28 and REVERTED the zoning to A-R (Agricultural-Residential), as reco~ranended b the Mohave County Plarming and Zoning Commission and outlined herein. /~ ~  ~, [NTY BOARD OF SUPERVISORS Buster D.
