RESOLUTION NO. 99-450
A RESOLUTION SETTING FORTH A REZONE OF THE SW¼ SW¼ SE¼ OF SECTION 16, IN
TOWNSHIP 39 NORTH, RANGE 16 WEST, FROM A-R (AGRICULTURAL-RESIDENTIAL)
ZONE TO C-2 (GENERAL COMMERCIAL) AND A-R (AGRICULTURAL-RESIDENTIAL)
ZONES, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
6, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the
above-described property as requested by Jacob R. Youngman of Denver, Colorado, and
WHEREAS, this property is located south of Interstate 15 and south of Mesquite, Nevada in the
Scenic area of Mohave County. The site is accessed from Mesquite, Nevada via east on Elbow Canyon
Road to the site, located on the north side approximately one-half (V2) mile west of Littlefield Drive. The
property is vacant and relatively flat, sloping slightly to the north. The surrounding land uses consist of
vacant land and single-family residences. There are no significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for duplexes and a mini-storage
building. The applicant proposes to divide the ten-acre gross parcel north and south into three parcels of
3.19, 2.83 and 2.83-acre net, each all fronting on Elbow Canyon Road, but due to the area plan land use
designation the applicant must divide his property east to west with all the commercial property fronting on
Elbow Canyon Road. The Mohave County General Plan designates this area as an Urban Development Area
and the Virgin River Communities Area Plan designates the approximate 200 feet adjacent to Elbow Canyon
Road as COM (Commercial [C~2 (General Commercial) and C-2H (General Commercial Highway
Frontage)]) and the remainder of this area as HDR (High Density Residential, 12 to 16 dwelling units per
acre), and
WHEREAS, a review of FEMA FIRM Panel #040058-0200B indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and the effect complies with the Mohave County General Plan and the
Virgin River Communities Area Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area contains other like land uses similar to the above-proposed action.

e. The site has legal access.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on
November 10, 1999, the Commission recommended APPROVAL for a Rezone subject to the following:
1. This property adjacent to Elbow Canyon Road will be rezoned to C-2 (General Commercial)
and the northern portion of this property will be rezoned to A-R (Agricultural-Residential).
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements)
must be completed and approved prior to approval of permits and before establishing the use
on the commercial zoned property.
3. The submittal and recordation of a Parcel Plat prepared in accordance with Article 3.16 of
the Mohave County Subdivision Regulations and 102.04-B of the Standard Specifications
and Details is required.
4. The 42 feet road right-of-way adjacent to the south boundary for Elbow Canyon Road and
the 35 feet road right-of-way adjacent to the west boundary of this property shall be
dedicated to Mohave County on behalf of the public and accepted by the Mohave County
Board of Supervisors as road rights-of-~vay. In addition, a 20-foot radius curve at the
roadway intersection point of Elbow Canyon Road and the 35-foot dedication along the west
boundary of this property shall be dedicated to Mohave County on behalf of the public and
accepted by the Mohave County Board of Supervisors as road right-of-way.
5. The eight feet adjoining to all rights-of-way shall be granted to the public as a Public Utilities
Easement (PUE).
6. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
7. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
8. Each pamel shall have legal access.
9. The applicable flood zone(s) shall be noted on the Parcel Plat.
10. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
11. The rezone shall not become effective until at least 30 days after final approval of the change
in classification by the Board of Supervisors, as per ARS 11-829E.

12. if these conditions are not met within one year this approval will be void. If at the expiration
of this period the property has not been improved to meet the use for which it was
conditionally approved, the Board of Supervisors (after notification by registered mail to the
owner and applicant who requested the rezoning) shall schedule a public heating to grant an
extension, determine compliance with the schedule for development, or cause the property
to revert to its former zoning classification. This action is in accordance with Arizona
Revised Statutes Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 6, 1999, APPROVED this Rezone as recommended by the Mohave County Planning
and Zoning Commission and outlined herein.
