HomeMy WebLinkAbout99-454 OFFICIAL RECORDS OF' MOiiAVE {:OUNFY ,.lOAN HO C;AL.L.~ ~OH~VE COUNf'f RECORDEF: 2,/:7!]999 04:26F' P~GE ! qF 2 MOH~VE ¢OIJNTY 80~RD OF SUPERVISORS RECORDIN6 FEE 0.': RESOLUTION NO. 99-454 A RESOLUTION SETTING FORTH A RESCISSION OF BOS RESOLUTION NOS. 98-1 AND 98- 2, WHICH CONDITIONALLY APPROVED THE ?RELIMINARY PLAN AND REZONING ]FOR MOHAVE MEADOWS SUBDIVISION, TRACT 3509, BEING A FORMERLY PROPOSED SUBDIVISION OF A PORTION OF SECTION 5, TOWNSHIP 40 NORTH, RANGE 15 WEST, IN THE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether the conditional Preliminary Plan approval for the above-described subdivision should be rescinded. The new property owner is George Hamilton, Beaver Dam, Arizona. The engineer of record was L.R. Pope Engineers and Surveyors, St. George, Utah, and WHEREAS, the property is located less than one mile north of the I-15/Highway 91 interchange. The site is accessed via Interstate 15, then north approximately three-quarters of a mile along Highway 91, then southeast one-quarter mile along and south of Beaver Dam Drive to the site, and WHEREAS, the Preliminary Plan depicts 3.28 acres subdivided into 11 single-family residential lots and two open space parcels. The residential lots have an average lot size of 7,000 square feet, and a minimum lot size of 6,500 square feet, and WHEREAS, the former owner and developer of this property, Brian Whittaker, has advised Mohave Comity that this property has been sold to George Hamilton of Hamilton Ranch LLC. Mr. Hamilton states in a letter received October 4, 1999, that he intends to develop this property as part of the Beaver Dam golf course, and that '~the subdivision has been abandoned", as the property is no longer proposed for subdivision, and WHEREAS, the Preliminary Plan for Mohave Meadows Subdivision, Tract 3509, was conditionally approved by the Mohave County Board of Supervisors on January 5, 1998, per BOS Resolution No. 98-1, and WHEREAS, the rezoning of this property, from A-R to R-O, was conditionally approved in conjunction with the proposed subdivision on January 5, 1998, per BOS Resolution No. 98-2. The proposed subdivision zoning did not take effect as the subdivision plat was not recorded. The property remains zoned A-R, as the subdivision plat proposal has been withdrawn by the property owner, and RESOLUTION NO. 99-454 Page 2 WHEREAS, at the public hearing before the Mohave County Planrfing and Zoning Commission on November 10, 1999, the Commission reconunended APPROVAL of the Rescission of the Preliminary Plan approval and rezoning for Mohave Meadows Subdivision, Tract 3509, subject only to the provision that the property revert to A-R zoning, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19. 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED this rescission of the Preliminary Plan approval and rezoning for Mohave Meadows Subdivision, Tract 3509, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. ~UNTY BOARD OF SUPERVISORS Buster D. o~nson, Chairman PAGE '2 OF' 2 BK 34-20 PG 437 FEE~99!)Z1657
