RESOLUTION NO. 99-456
A RESOLUTION SETTING FORTH AN EXTENSION OF TIME OF THE APPROVED
PRELIMINARY SUBDIVISION PLAN OF SUNSET RANCHOS Il, TRACT 4156, BEING A
SUBDIVISION OF A PORTION OF SECTION 13, TOWNSHIP 19 NORTH, RANGE 22 WEST, IN
THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
6, 1999, a public hearing was conducted to determine whether approval should be granted for an Extension
of Time as requested by the developer/agent, Dan Oehler, for Mashura Properties, Bullhead City, Arizona,
for the above-described Preliminary Plan. The new engineer of record is A-N West, Inc., Bullhead City,
Arizona, and
WHEREAS, the property is located approximately one-half mile southeast of Bullhead City. The
land is accessed via State Highway 95, then east one mile along Camp Mohave Road, then north over one-
half mile along Mountain View Road, then east along Sundance Road to the site, and
WHEREAS, the Preliminary Plan depicts 12.5 acres subdivided into 22 single-family residential
lots, with a minimum lot size of 21,780 square feet. This development is a subdivision of Lots 10 and 11,
Block 8; Lots 7 through 12, Block 14; Lots 6 and 7, Block 9; and Lot 7, Block 11 of existing Sunset
Ranchos, Tract 4046-B. The developer has proposed no phasing for this subdivision. The developer has
proposed the use of financial assurances for the required and the proposed improvements for the subdivision.
The form of the assurance has not yet been identified or approved, and
WltEREAS, the developer has indicated in a letter dated October 4, 1999, that an Extension of Time
is being requested, as the developer's new engineer needs more time to recreate, submit, process and record
the Final Plat and supporting documents for the subdivision, and
WHEREAS, the Preliminary Plan for this tract was approved by the Mohave County Board of
Supervisors on January 2, 1996, per BOS Resolution No. 96-11. The first Extension of Time of the
conditional Preliminary Plan approval for this subdivision was granted on April 6, 1998, per BOS
Resolution No. 98-109. The second extension was granted on December 7, 1998, per BOS Resolution No.
98-43 l, with project approval automatically expiring on January 2, 2000. Subdivision Regulations, Article
3.10-1 states: "Upon application to the Commission and prior to the expiration of the time limit, extensions
in increments of one (1) year may be granted by the Board of Supervisors if the subdivider is actively
processing the Final Plat. If such action is not taken then all proceedings relating to the plat shall be
terminated.", and

WHEREAS, there appears to have been no progress since the previous extension which would
advance this project toward recordation, and no progress has been demonstrated since the previous extension
toward a resolution of the method of sewage disposal for this subdivision, and
WHEREAS, the Mohave County Public Works Department has indicated that upon receipt of any
additional submittals of this project for processing, the adequacy of the drainage and compatibility of this
proposed subdivision with surrounding development, including without limitation roadways and easements,
including utilities and drainage, will be reviewed, and has recommended that any required changes or
modifications will be the responsibility of the developer, and
WHEREAS, this action, if approved, will be the third Extension of Time for the conditional
Preliminary Plan approval of this proposed subdivision, and
WHEREAS, the following are Findings of Fact for the above captioned item:
a. All notices have been advertised and posted according to regulations.
b. This request does not comply with the Extension of Time Policy.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on
November 10, 1999, the Commission recommended APPROVAL of an Extension of Time for the
Preliminary Plan subject to the following conditions:
1. Compliance with all conditions of BOS Resolution Nos. 96-11, 98-109, and 98~431.
2. If during the development of this project it is determined that the use of septic systems within
this subdivision is not acceptable to the Arizona Department of Environmental Quality or the
Mohave County Enviromnental Health Division, the subdivision may have to be redesigned.
Such redesign may require an amendment to the Preliminary Plan approval or the submittal
of a new Preliminary Plan or Sketch Plan.
3. Unless significant progress is made in the coming year toward the recordation of this
subdivision, Planning staff will recommend denial of requests for further Extensions of Time
of the conditional Preliminary Plan approval for this tract.
4. This Extension of Time will be in effect until January 2, 2001.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 6, 1999, APPROVED this Extension of~ime as recommended by the Mohave
County Planning and Zoning Commission and or, lined herein//
