I ~v '~-,' rfc, ~OHAVE r:O JNTY BOARO OF . o .... · RECORDING FEE O~DO RESOLUTION NO. 99-458 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 30, BLOCK AA, TIERRA VERDE, UNIT 1, TRACT 1073-A, IN SECTION 14, TOWNSHIP 19 NORTH, RANGE 22 WEST, FOR A COMMERCIAL MODULAR IN A C-2H (GENERAL COMMERCIAL HIGHWAY FRONTAGE) ZONE, IN THE SOUTH MOHAVE VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by John Voldo of Fort Mohave, Arizona, and WHEREAS, this property is located east of State Highway 95, between Valencia Road and Camp Mohave Road. The site is accessed from State Highway 95 via east on Valencia Road to the Frontage Road, then south on the Frontage Road approximately 450 feet to the site, located on the east side. The property has a general commercial building being used as a transmission shop on it. The terrain is relatively flat, sloping slightly to the ~vest toward the Colorado River. The surrounding land uses consist of general commercial businesses on both sides of State Highway 95. There are single family residences to the east. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a commercial modular in a C-2H (General Conunercial Highway Frontage) zone. The Mohave County General Plan designates this area as an Urban Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2435D indicates the parcel described to be in Zone AO, in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site, except the noted Special Flood Hazard Area. RESOLUTION NO. 99-458 Page 2 WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on November 10, 1999, the Commission recommended DENIAL for a Zoning Use Permit based upon the following: 1. The requested use is incompatible with the surrounding uses. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, DENIED this Zoning Use Permit as recormnended by the Mohave County Planning and Zoning Commission and outlined herein. 7oa o RViSORS ' "~ ~ :)':' Buster D.
