HomeMy WebLinkAbout99-464 79Cg-?~1.66~ BK 3420 F'G OFFICIAL RECOROS OF MOHAVE COUNTY JOAN MC CALL~ MOHAVE COUNTY RE( !2/]7/1999 04:29P PAGE ! {]~ 2 HOHAVE COUNTY BOARO OF SUPERVZSORS RECOROING FEE RESOLUTION NO. 99-464 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NWIA NW¼, THE S¼ NW¼ AND THE NE¼ SW¼ OF SECTION 13, IN TOWNSHIP 22 NORTH, RANGE 20 WEST, FOR A PROPANE SALES TANK IN A C-RE/36A (COMMERCIAL-RECREATION~THIRTY-SIX ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN VALLEY AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above-described property as requested by Ronald E. Gardner of Golden Valley, Arizona, and WHEREAS, this property is located north of State Highway 68, west of Bapchule Road, northwest of the Golden Valley Area. The site is accessed from State Highway 68 via north on Egar Road approximately five and one-quarter (5~A) miles to Jurassic Drive, then west on Jurassic Drive approximately three and one-half (3½) miles to the property. The property has a single-family residence on it, several accessory buildings and is being used as a cattle ranch. The terrain is rolling hills, generally sloping to the east and southeast. The surrounding land uses consist of vacant Bureau of Land Management (BLM) land. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a propane sales tank in a C-RE/36A (Commercial-Recreation/Thirty-six Acre Minimum Lot Size) zone. The Mohave Comity General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-2125C indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Conmfission on November 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-464 Page 2 1. This Zoning Use Permit is for a propane sales tank in a C-RE/36A (Commercial- Recreation/Thirty-six Acre Minimum Lot Size) zone and activities related thereto. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 3. The applicant will comply with all the requirements of the State Fire Marshal's Office and the local fire department. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or use has not conunenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and ontlined herein. · '¥~ Buster D.
