MOHAVE COUNTY BOARD OF SUF'ER¥IS~]EB RECORDING FEE 0.00 RESOLUTION NO. 99-467 A RESOLUTION SETTING FORTH A REZONE OF LOT 98, GATEWAY ACRES, TRACT 9, IN SECTION 9, TOWNSHIP 25 NORTH, RANGE 19 WEST, FROM A-R/5A (AGRICULTURAL- RESIDENTIAL/FIVE ACRE MINIMUM LOT SIZE) ZONE TO C-MO (COMMERCIAL- MANUFACTURING/OPEN LOT STORAGE) ZONE, IN THE DOLAN SPRINGS PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by Louis F. Desmarais of Dolan Springs, Arizona, representing the owners, Daniel P. and Allie L. McElrath of Dolan Springs, Arizona, and WHEREAS, this property is located east of US Highway 93 on Pierce Ferry Road. The site is accessed from US Highway 93 via northeast on Pierce Ferry Road approximately three miles to the site, located on the east side of Del Norte Drive amd on both sides of Pierce Ferry Road. The property is vacant and relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant land, scattered single-family residences and other general commercial businesses along both sides of Pierce Ferry Road. There are no significant drainage patterns, and WHEREAS, the applicant requests this zone change to allow for a second operation machine shop. The Mohave County General Plan designates this area as a Rural Development Area and the Dolan Springs Area is considered an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the tbllowing described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WItEREAS, at the public heating before the Mohave County Planning and Zoning Commission on November 10, 1999, the Commission recommended APPROVAL for a Rezone subject to the following: !:'fi6E 2 CiE' 2 BF ~4-20 PE; 474 ,¢EE~9%'Tt670 RESOLUTION NO. 99-467 Page 2 1. This property will be rezoned C-MO (Commercial-Manufacturing/Open Lot Storage). 2. The applicant will provide a view-obscuring fence around the open lot storage portion of this property. 3. The existing 100-foot roadway easement, known as Pierce Ferry Road, shall be dedicated to Mohave County on behalf of the public and accepted by the Mohave County Board of Supervisors as road right-of-way. This will be accomplished via a separate instrun~ent. 4. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval ofpemtits and before establishing the use. 5. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 6. The rezone shall not become effective until at least 30 days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 7. If these conditions are not met within one year this approval will be void. If at the expiration of this period the property has not been improved to meet the use for which it was conditionally approved, the Board of Supervisors (after notification by registered mail to the owner and applicant who requested the rezoning) shall schedule a public hearing to grant an extension, determine compliance with the schedule for development, or cause the property to revert to its former zoning classification. This action is in accordance with Arizona Revised Statutes Annotated, Title I l, Chapter 6, 11-832. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED this Rezone as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
