HomeMy WebLinkAbout99-468 OFFICIAL RECORDS OF MOHAVE (:OUNTY ,lOAN MC CALL., MOHAVE COLtNI'Y RE(gRDE~;: · 7/,' ~' / oQ PAGE OF: ~ ...... 1%, 04:30P t 2 MOHAVE COUNTY BOARD OF SUF'ERVi:SORS RECORDING FEE RESOLUTION NO. 99-468 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON LOT 16, PLEASANT VALLEY ACRES, IN SECTION 20, TOWNSHIP 25 NORTH, RANGE 19 WEST, FOR A SECONDARY RESIDENCE IN AN A (GENERAL) ZONE, IN THE DOLAN SPRINGS PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether a Zoning Use Pem~it should be granted for the above-described property as requested by Kenneth D. and Odette M. Steck of Dolan Springs, Arizona, and WHEREAS, this property is located east of US Highway 93, on the north side of Pierce Ferry Road. The site is accessed from US Highway 93 via northeast on Pierce Ferry Road to the site, located on the northeast comer of Pierce Ferry Road and Bullhead Road. The property has a single-family residence and several accessory buildings on it. The terrain is relatively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant land, several single-family residences and several general commercial businesses along each side of Pierce Ferry Road. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit to allow for a secondary residence in an A (General) zone for the applicant's son. The Mohave County General Plan designates this area as a Rural Development Area. Dolan Springs is considered an Outlying Community, and WHEREAS, a review of FEMA FIRM Panel #040058-1775B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Ama, and WHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant enviromnental features affecting the site. WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on November 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-468 Page 2 1. This Zoning Use Permit is for a secondary residence on this property and the activities related thereto. The floor area of the secondary residence shall comply with the size requirements in Section 27.R (Accessory or Secondary Residence Requirements). As per the Mohave County Zoning Regulations, the secondary residence will be used for non-paying guests and relatives ONLY. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations, Section 27.R (Accessory or Secondary Residence Requirements) and a site plan prepared in accordance with Section 27.R must be completed and approved prior to approval of permits and before establishing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. If construction or use has not commenced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, amd posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
