RESOLUTION NO. 99-469
A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE NE¼ NWl/4 OF SECTION
34, TOWNSHIP 29 NORTH, RANGE 17 WEST, FOR A WIRELESS COMMUNICATIONS
FACILITY WITH A 100-FOOT TOWER IN AN A-R/36A (AGRICULTURAL-RESIDENTIAL/
THIRTY-SlX ACRE MINIMUM LOT SIZE) ZONE, IN THE MEADVIEW PORTION OF THE
MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December
6, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for
the above-described property as requested by Brace A. Mitchell, Right-of-Way Agent for Mohave Cellular
Limited Partnership, dba Citizens Mohave Cellular of Kingman, Arizona, and
WHEREAS, this property is located on the west side of Pierce Ferry Road, approximately seven
(7) miles north of Antares Road. The site is accessed from Pierce Ferry Road via west on Patterson Slope
Drive approximately one-half(½) mile to the site, located on the top of Patterson Peak. The property is
mountainous with a communications site near the top. The surrounding land uses consist of vacant land.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit for a wireless communications facility
with a 100-foot tower in an A-R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size) zone.
The Mohave County General Plan designates this area as a Rural Development Area, and
WHEREAS, a review of FEMA FIRM Panel #040058-1450C indicates the parcel described to be
in Zone C, not in the FEMA Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above-captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect complies with the Mohave County General Plan.
c. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
e. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Cormnission on
November 10, 1999, the Commission recommended APPROVAL for a Zoning Use Permit subject to the
following:

1. This Zoning Use Permit is for a wireless communications facility consisting of a 100-foot
maximmn height tower and related equipment as shown on Exhibit "A" and activities related
thereto.
2. The applicant shall comply with all applicable provisions of the Mohave County Zoning
Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements)
must be completed and approved prior to approval of permits and before establishing the use.
3. The applicant shall comply with ail applicable regulations of the Federal Aviation
Administration (FAA) and will coordinate with the FAA for any conflicts with any published
Military Low Level Training Routes.
4. The applicant will coordinate with the Air Space Management Division at Nellis Air Force
Base, Nevada for any conflicts with the Military Low Level Training Routes managed by
them.
5. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
6. If construction or use has not commenced within one year of Board approval of the Zoning
Use Permit or if the use has been discontinued for six months, then approval shall terminate
at that date.
7. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of
Supervisors if, in the opinion of the Commission and Board, the continued use of the
property would be contrary to the public health, safety, and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, December 6, 1999, APPROVED this Zoning Use Permit as reconm~ended by the Mohave
Cou and Zoning Commission and outlined herein.
