WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the aSove-described property as requested by Donald and Diane Hughes of Kingman, Arizona, and WHEREAS, this property is located on the west side o£ State Highway 66 (Old US Highway 66) and north o£the Kingman Airport Industrial Park. The site is accessed directly from State Highway 66 to the northwest and is located approximately three and two-tenths (3.2) miles northeast of the entrance to the Kingman Airport Industrial Park. The property has a single-family residence and several accessory buildings on it. The terrain is relmively flat, sloping slightly to the southwest. The surrounding land uses consist of vacant land and single-family residences. There are no significant drainage patterns, and WHEREAS, the applicant requests this Zoning Use Permit for a dog kennel in an A (Oeneral) zone. The Mohave County Oeneral Plan designates this area as a Suburban Development Area, and WHEREAS, a review of FEM^ FIRM Panel #04005g-2160B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, this action is to correct a violation of Section 9, Definitions, of the Mohave County Zoning Regulations, Kennel: An area in which five (5) or more dogs are being kept, and WHEREAS, the following described Findings o£Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect complies with the Mohave County Oeneral Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing be£ore the Mohave County Planning and Zoning Connnission on November 10, 1999, the Commission recommended ^PPROVAL for a Zoning Use Permit subject to the following: RESOLUTION NO. 99-470 Page 2 1. This Zoning Use Permit is for a dog kennel with a maximum of nine dogs in an A (General) zone and activities related thereto. The applicant will use a bark preventive method to keep the dogs quiet between the hours of 9:00 PM and 6:00 AM. 2. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establistfing the use. 3. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 4. if construction or use has not conm~enced within one year of Board approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 5. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and Board, the continued use of the property would be contrary to the public health, safety, and welfare. WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED this Zoning Use Permit as recommended by the Mohave County Plmming and Zoning Commission and outlined herein.
