DER ~2/07/~999 04~3~P P~GE t OF .4 flOH~VE COUNTY BO~RO OF' m ¢~en',c RECORDING FEE RESOLUTION NO. 99-471 A RESOLUTION SETTING FORTH AN AMENDMENT TO RESOLUTION P&ZC: 81-86 SETTING FORTH A ZONING USE PERMIT ON A PORTION OF THE SW¼ SW¼ SE¼ OF SECTION 4, TOWNSHIP 15 NORTH, RANGE 14 WEST, FOR A COMMUNICATIONS SITE IN AN A-R (AGRICULTURAL-RESIDENTIAL) ZONE, IN THE WIKIEUP PORTION OF THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to determine whether an Amendment to Resolution P&ZC: 81-86, setting forth a Zoning Use Permit, should be granted for the above-described property as requested by Bruce A. Mitchell, Right-of-Way Agent for Mohave Cellular Limited Partnership, dba Citizens Mohave Cellular of Kingman, Arizona, and WHEREAS, the language to be added has been bolded. Language to be deleted has been and WHEREAS, this property is located west of US Highway 93 and south of Chicken Springs Road in the Wikieup Area. The site is accessed from US Highway 93 via west on Chicken Springs Road approximately seven (7) miles to a ranch road running to the south up Aubrey Peak. The site is located on the north slope of Aubrey Peak near the top. The property is mountainous with a communications site on the top. The surrounding land uses consist o£vacant land. The terrain generally slopes to the north. There are no significant drainage patterns, and WHEREAS, the applicants request this Amendment to Resolution P&ZC: 81-86, approving a Zoning Use Permit, to delete the requirement for a height variance and to allow for a 170-foot tower on the existing Citizens Utilities Rural Company Communications site on Aubrey Peak near Wikieup, Arizona. In addition, several conditions are added to bring the site in compliance with the Federal Aviation Administration (FAA) requirements and current Mohave County zoning requirements, and WHEREAS, the Mohave County General Plan designates this area as a Rural Development Area, and WHEREAS, a review of FEMA FIRM Panel #040058-3050B indicates the parcel described to be in Zone C, not in the FEMA Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above-captioned item: RESOLUTION NO. 99-471 Page 2 a. All notices have been advertised and posted according to regulations. b. The proposed action and the effect complies with the Mohave County General Plan. c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The site has legal access. e. There are no significant environmental features affecting the site. WHEREAS, at the public hearing before the Mohave County Planning and Zoning CmrLmission on November 10, 1999, the Commission recommended APPROVAL of the proposed Amendment to Resolution P&ZC: 81-86 setting forth a Zoning Use Permit, subject to the following: 1. If construction or use has not commenced within two (2) years of the Board of Supervisors approval of the Zoning Use Permit, of if the use had been discontinued for six months, then approval shall terminate at that date. 2. This Zoning Use Permit is subject to revocation upon sixty (60) days notification by the Board of Supervisors if, in the opinion of the Commission amd Board, the continued use of the property would be contrary to the public health, safety, and welfare. 3. That a Zoning (Building) Permit be obtained. 4. This Zoning Use Permit is for a wireless communications facility consisting of a 170-foot maximum height tower and related equipment as shown on Exhibit "A" and activities related thereto. 5. The applicant shall comply with all applicable provisions of the Mohave County Zoning Regulations. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. 6. The applicant shall comply with all applicable regulations of the Federal Aviation Administration (FAA) and will coordinate with the FAA for any conflicts with any published Military Low Level Training Routes. 7. The applicant will coordinate with the Air Space Management Division at Nellis Air Force Base, Nevada for any conflicts with the Military Low Level Training Routes managed by them. RESOLUTION NO. 99-471 Page 3 WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Boaxd of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED this Amendment to Resolution P&ZC: 81-86 setting forth a Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein.
