WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on December 6, 1999, a public hearing was conducted to consider whether an amendment to Section 9, Definitions, and Sections 13, 14, 15, 16, 16.1, 17, 18 and 27 of the Mohave County Zoning Regulations regarding Model Homes should be approved, and WHEREAS, the construction of model homes and their use as sales offices in the unincorporated areas of Mohave County requires regulations in order to protect and preserve the health, safety and welfare of the citizens of the county, and WHEREAS, the construction of model homes and their use as sales offices in the unincorporated areas of Mohave County requires regulations in order to protect and preserve property values, to provide a means of determining guidelines for the layout and construction of model homes, and the rules under which sales offices would operate that would not affect the integrity of residential neighborhoods, and WHEREAS, the requirements for establishment of guidelines for the layout and construction of model homes and their use as sales office has evolved since Section 27 was adopted and Mohave County needs to be sensitive to these changes, and WHEREAS, this amendment will clearly set the guidelines for the layout and construction of model homes and their use as sales offices, the type of permitting required, the zones it will be allowed in and the conditions to be met, and WHEREAS, at the public heating before the Mohave County Planning and Zoning Commission on October 13, 1999, the Commission recommended APPROVAL of the attached P&ZC Resolution No.99-5, an amendment to Section 9, Definitions, and Sections 13, 14, 15, 16, 16.1, 17, 18 and 27 of the Mohave County Zoning Regulations regarding Model Homes, and WHEREAS, the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman, Mohave County, Arizona, November 17, 1999, and posted on November 19, 1999, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. P&ZC RESOLUTION NO. 99-5 A PLANNING AND ZONING COMMISSION RESOLUTION SETTING FORTH AN AMENDMENT TO SECTION 9, DEFINITIONS, AND SECTIONS 13, 14, 15, 16, 16.1, 17, 18 AND 27 SECTION OF THE MOHAVE COUNTY ZONING REGULATIONS REGARDING MODEL HOMES. The Mohave County Zoning Ordinance is amended as follows (added language is bolded; deleted language is Section 9 DEFINITIONS Between Mobile Home Subdivision and Motel add: Model Home and Sales Office: Houses built for the specific intent to be displayed for sale and to be built at another location. The model home will sold as a single-family residence no later than when the last lot in the subdivision is sold. Model Homes and Sales Office in approved subdivisions prior to Final Plat approval: See Section 27.B.7. Section 14.C.8: Add MODEL HOMES AND SALES OFFICE. Section 14 REGULATIONS FOR AGRICULTURAL/RESIDENTIAL OR "A-R" ZONE. C. Uses Permitted After Acquiring a Zoning Use Permit. 8. Model Homes and Sales Office. (See: Section 27.B.b, c & e) Section 15.C.5: Add MODEL HOMES AND SALES OFFICE. Section 15 REGULATIONS FOR RECREATION OR "R-E" AND "C-RE" ZONE. C. Uses Permitted After Acquiring a Zoning Use Permit. 5. Model Homes and Sales Office. (See: Section 27.B.b, c & e) P&ZC RESOLUTION NO. 99-5 Page 2 Section 16.C.5: Add MODEL HOMES AND SALES OFFICE. Section 16 REGULATIONS FOR SINGLE-FAMILY RESIDENTIAL OR "R- 1", "R-O", "R-TT" ZONES. C. Uses Requiring a Zoning Use Permit. 5. Model Homes and Sales Office will be allowed in "R-l"and "R-O" zones ONLY. (See: Section 27.B.b, c & e) Section 16.1.C: Add MODEL HOMES AND SALES OFFICE. Section 16.1 REGULATIONS FOR SINGLE-FAMILY RESIDENTIAL/HOMES ONLY/LIMITED ANIMAL PRIVILEGES OR R-O/A ZONE. C. Uses Permitted After Acquiring a Zoning Use Permit. 4. Model Homes and Sales Office. (See: Section 27.B.b, c & e) Section 17. C. Add MODEL HOMES AND SALES OFFICE. Section 17 REGULATIONS FOR SINGLE-FAMILY RESIDENTIAL/MOBILE HOME OR R-MH ZONE. C. Uses Permitted After Acquiring a Zoning Use Permit. 3. Model Homes and Sales Office. (See: Section 27.B.b, c & e) Section 18. C. Add MODEL HOMES AND SALES OFFICE. Section 18 REGULATIONS FOR MULTIPLE-RESIDENTIAL OR "R-M" ZONE. C. Uses Permitted After Acquiring a Zoning Use Permit. 4. Model Home and Sales Office. (See: Section 27.B.b, c & e) P&ZC RESOLUTION NO. 99-5 Page 3 F'A6E 4 OF 5 BK 3421 P6 t21 Section 27.A Special Uses: The following uses ma)' be permitted in zones in which they are not specifically permitted by this Ordinance, where such uses are deemed essential or desirable to the public convenience or welfare, and are in harmony with the various elements or objectives of the General Plan. In each instance, the matter shall be processed as a Zoning Use Permit. 4. (ADDED) Layout and construction of model homes and their use as sales offices in an approved subdivision prior to Final Plat Recordation. Section 27.B. Building Sites: 7. (ADDED) Layout of building site for model homes to be used as sales offices in an approved subdivision prior to Final Plat Recordation. a. Future/proposed lots to be used as building sites will be surveyed and staked according to accepted surveying principals by an Engineer registered as a land surveyor or a Registered Land Surveyor licensed in the State of Arizona. The lots will follow the same configuration as the Approved Preliminary Subdivision Plat. b. All required Zoning, Building, Environmental Health, and Flood Plain permits will be secured prior to construction of any structures. c. When the use of the model home as a sales office has ceased and the sale of the home is imminent all changes made to accommodate the sales office will be removed and the model will be converted back to a single family dwelling unit and will be inspected for compliance with the appropriate code. The model home may not be sold until the recordation of the Final Plat. d. None of the models approved for construction and to be used as sales offices will be sold. No permits will be approved for constructing homes on lots in this subdivision, other than those approved via the Zoning Use Permit prior to the recordation of the Final Plat. e. The home can not be inhabited as long as it functions as a Model Home and Sales Office. fi Model Homes and Sales Offices in a subdivision cannot be use to sell lots outside of the subdivision. RESOLUTION NO. 99-478 Page 2 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, December 6, 1999, APPROVED the attached P&ZC Resolution No. 99-5, an amendment to Section 9, Definitions, and Sections 13, 14, 15, 16, 16.1, 17, 18 and 27 of the Mohave County Zoning Regulations regarding Model Homes, as recommended by the Mohave County Planning and Zoning Commission and outlined herein. :, **. ~A~C~TY BOARD OF SUPERVISORS Bu~ter D.
