RESOLUTION NO. 2004-114
A RESOLUTION SETTING FORTH AN APPROVAL OF A SUBDIVISION FINAL PLAT AND AN
ACCEPTANCE OF AS-BUILT IMPROVEMENT PLANS FOR DESERT LAKES ESTATES,
TRACT 4152-C, BEING A SUBDIVISION OF A PORTION OF THE SW~ OF SECTION 36,
TOWNSHIP 19 NORTH, RANGE 22 WEST. IN THE SOUTH MOHA VE V ALLEY AREA,
MOHA VE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on April 5,
2004 a public hearing was conducted to determine whether a Final Plat should be approved, and as-bui It
improvement plans accepted for the above-referenced subdivision, as proposed by Mohave Desert Partners,
Angelo Rinaldi, Fort Mojave, Arizona, and .1.1. Miller, Calgary, Alberta, Canada. The project engineer is
TelTitorial Engineers Inc., Bullhead City, Arizona, and
\VH EREAS, the property is located approximately four (4) miles south of Bullhead City. The site is
accessed via State Highway 95, then east along, and north of Lipan Boulevard, and
WHEREAS, the Preliminary Plan for Desert Lakes Estates, Tract 4152, was conditionally approved
by the Board of Supervisors on June 6, 1994, per BOS Resolutions 94-170, and
\VHEREAS, the Final Plat for Desert Lakes Estates, Tract 4152-C, includes approximately 11.63
acres subdivided into 42 single-family residential lots, ranging from 8,047 to 13,570 square feet in size, and
WHEREAS, the Final Plat for Tract 4152-C has becn reviewed by requisite agencies and
departments. The County Engineer has recommended, in his 111e1110 dated February 6,2004, that the as-built
(record drawing) improvement plans be accepted. Other than as-built plans, no assurances arc proposed.
WHEREAS, this Final Plat is being processed per provisions of the Mohave County Subdivision
and Road Maintenance Regulations, and
\VHEREAS, the advertising requirements have been met throughoLlt this subdivision process.
NO\V THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, Apri I 5,2004, APPROVED the Final Plat, and ACCEPTED the as-built improvement plans for
Tract 4152-C, subject to the following conditions:

1.
The developer will make the same commitments for improvements in the prospectus to the Arizona
Department of Real Estate as required for approval ofthis tract by the Board, and a final copy of the
public report shall be submitted to the Planning and Zoning Department.
2.
A current title report (dated within 30 days or recordation) must be providedlo the Planning and
Zoning Department prior to plat recordation.
3.
Lots and parcels within the recorded Final Plat for Desert Lakes Estates, Tract 4l52-C, will not be
further divided or otherwise altered from their approved, platted form.
4.
The Mohave County Land Division Regulations require that final Plats approved (or conditionally
approved) under the provisions of the Mohave County Subdivision and Road Maintenance
Regulations, be recorded within two years of the date of the approval of the Final Plat. If the Final
Plat for this subdivision is not recorded on or before March 20,2005, all approvals for Desert Lakes
Estates, Tract 4152-C, shall be void, and the developer shall be required to starl over processing of
this subdivision per the provisions of the Mohave County Land Division Regulations.
BE IT FURTHER RESOLVED, that a com~ct copy of all plats and documenls delineated above,
and in any outstanding review, shall be submitted to Plmming and Zoning for distribution and review. Upon
receipt or evidence that these conditions have been met, together with the executed mylars and appropriate
recording rees, the Director of Planning and Zoning will obtain the necessary signatures from the County
departments and officials and cause the Final Plat for Desert Lakes Estates, Tract 4152-C, to be recorded.

All improvements for, Desert Lakes Estates, 4] 52-A have been completed by the Developer.
Such improvements are more particularly documented by the following:
Project Engineering and Surveying by Ray Stadler, P.E., R.L.S, Stadler Consulting Engineers,
Chuck Dewald, P.E., RLS, Territorial Engineers, Inc., William T. Miller, P.E., William T. Miller
Engineering, Inc. and Greg Robberson, RLS, High Technology Land Surveying.
Final Plat prepared by Stadler Consulting Engineers P.E., R.L.S., and recorded on or about
November 28, 1995.
Material Tests by Western Technologies Inc. 3/26/96 and Southwest Technologies, dated 12/5/02
The improvements have been inspected and substantially conform to the plans, specifications and
County Standards.

CONSTRUCTION OF IMPROVEMENTS
FIRST AMERI CAN will not transfer, release or in any way convey, any of the property
described herein without obtaining written approval from 'TIllE eIT'! or KINGMifN', except that
the Trustee may sell and covey all of the property described herein in one transaction to a single
purchaser, provided that such purchaser shall enter into an Assurance Agreement with th~Y
pursuant to TIlE CITY or KI'NCMAN Subdivision OreiR<iJlb:e No. ~ adopted ~ and all
amendments thereto.
Before approval shall be given by the ~Y, the improvements contemplated by THE
CITY or IUNCMf.N Subdivision QrdiHftnce No. '5&tadopted l~and all amendments thereto,
and as set forth in Plans and Specifications on file with the ~y shall be installed in accordance
with the applicable effY or KINGMAN codes and specifications.
The duration of this Assurance Agreement shall be until all improvements have been made
and this Assurance Agreement has no further force and effect.
