HomeMy WebLinkAbout2007-10A ORDINANCE NO 2007-010 A AN ORDINANCE SETTING FORTH AN AMENDMENT TO CHAPTER 8 FEES, OF THE MOHAVE COUNTY LAND DIVISION REGULATIONS PROVIDING FOR OUTSOURCING SUBDIVISION REVIEWS. Amend Chapter 8 of the Mohave County Land Division Regulations as follows (words or phrases to be deleted are struck, and words or phrases to be added are bolded): Application Fee (non-refundable) $1,750 each, for Preliminary Plans and Final Plats (with the initial submittal of the Preliminary Plan, and the Final Plat for each phase,PLUS the following review and other applicable fees) Preliminary Plan and Final Plat review fees $10 per acre plus $10 per lot/parcel/unit, with each review submittal. (minimum review fee of$500) The Planning Director shall have the option to waive a review fee after the initial review based upon a reasonable circumstance or an action out of control of the developer,e.g.: a review initiated by an action of the County; inconsequential minor revisions or corrections to a plat or related reports; lack of timely reception of some outside agency comments or requirements and similar issues that in the opinion of the Director do not warrant an additional charged review. The Planning Director shall, based upon a policy adopted by the Board of Supervisors, or at the request of an applicant send all or any part of the review process for Preliminary Plans and Final Plats to an outside review contractor chosen through the appropriate procurement process. The fee for any plan or plat sent to the review contractor shall be the cost of the contract review plus the normal fee as stated in this chapter. WHEREAS,at the regular meeting of the Mohave County Board of Supervisors held on December 3, 2007, a public hearing was conducted to determine whether an the Mohave County Land Division Regulations should be amended to allow the County to send subdivision plats to an outside consultant for review, and WHEREAS, at their meeting on November 14, 2007, the Mohave County Planning Commission considered an amendment to the Mohave County Land Division Regulations to increase the fees charged for the review of subdivision plats submitted to the County, and WHEREAS, an analysis of the Department's expenses compared to the revenue revealed that the Department was not capturing the full cost of processing and review, and WHEREAS,the Planning and Zoning Commission continued the proposed increase in fees for 90 days, and sent forward the provision providing for retaining an outside consultant to conduct subdivision reviews for consideration by the Board, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on November 18, 2007, and was posted on November 16, 2007, as required by Arizona Revised Statutes and the Mohave County Land Division Regulations. NOW THEREFORE BE IT RESOLVED,that the Mohave County Board of Supervisors,at their regular meeting on Monday, December 3, 2007, APPROVED Mohave County Ordinance No. 2007-010 A setting for a provision to sspnd subdivision plats to an outside consultant for review.
