HomeMy WebLinkAbout09/07/2004 Item 022 . ,-~ RESOLUTION NO. 2004-359 A RESOLUTION SETTING FORTH A REZONE OF LOT 16, BLOCK I, GOLDEN SAGE RANCHOS, UNIT 66, IN SECTION 3, TOWNSHIP 21 NORTH, Rt\NGE 19 \VEST, FROM A-R/2A (AGRICULTURAL-RESIDENTIAL/T'VO ACRE MINIMUM LOT SIZE) ZONE TO A-R (AGRIClJLTURAL-RESIDENTIAL/ONE ACRE MINIMUM LOT SIZE) ZONE, IN THE GOLDEN V ALLEY AREA, MORA VE COUNTY, ARIZONA. \VHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on September 7, 2004, a public hearing was conducted to determine whether approval should be granted to Rezone the above-described property as requested by KTH Consulting of Kingman, Arizona representing William M. Ca11er, President of American Liberty, Inc., of Laughlin, Nevada, and WHEREAS, this property is located north of Highway 68 between Egar Road and Estrella Road. The site is accessed from State Highway 68 via north on Egar Road to the property, located at the southeast intersection of Egar Road and Burro Drive. The property is vacant and the terrain generally flat, sloping slightly to the southeast. The surrounding land uses consist of vacant land and scattered single-family residences. There are no significant drainage patterns, and \VHEREAS, the applicant requests this zone change to allow for the creation of residential parcels. The applicant proposes to divide the 2.09-acre parcel into two I-plus acre parcels. The Mohave County General Plan and the Golden Valley Area Plan both designate this area as a Suburban Development Area, and \VHEREAS, a review ofFEMA FIRM Panel #040058-2140C indicates the parcel described to be in Zone C, not in the Special Flood Hazard Area, and 'VHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect comply \\'ith the .\1ohave County General Plan and the Golden Valley Area Plan. c. The site is adequate for the action intended and the use is consistent with the sLlITounding land uses and terrain. d. The neighboring area contains other land uses similar to the above-proposed action. e. The site has legal access. f. There are no significant environmental features affecting the site. d ~ . , RESOLUTION NO. 2004-359 PAGE 2 WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on August 1 l, 2004, the Commission recommended APPROVAL for a Rezone subject to the following: 1. This property ,,,,ill be rezoned A-R (Agricultural-Residential/One Acre Minimum Lot Size). No more than two parcels may be created with this rezone action. 2. The submittal and recordation of a Parcel Plat prepared in accordance with Chapter 7, Minor Land Divisions, of the Mohave County Land Division Regulations and 102.04-B of the Standard Specifications and Details is required. 3. A 20-foot radius curve shall be dedicated at the intersection ofEgar Road and Burrow Drive. 4. All rights-of-way dedicated and public easements granted on the Parcel Plat will be accepted by the Board of Supervisors upon Parcel Plat recordation. 5. Each parcel shall meet or exceed its respective acreage exclusive ofroadways. 6. Each parcel shall have legal access. 7. The applicable flood zone(s) shall be noted on tIle Parcel Plat. 8. The appropriate zoning, building, envirolUllental, and floodplain pemlits will be obtained prior to construction. The permits will not be issued until Parcel Plat recordation. 9. The Rezone shall not become effective until at least thirty (30) days after final approval of the change in classification by the Board of Supervisors, as per ARS 11-829E. 10. If the required Parcel Plat prepared in accordance with Chapter 7, Minor Land Divisions, of the Mohave County Land Division Regulations and 1 02.04-B of the Standard Specifications and Details is not recorded within one (I) year of Board of Supervisors approval, this rezone approval will be void. All other conditions are to be met upon the development of the property. Before the approval is declared void, the Board of Supervisors (after notification by registered mail to the owner and the applicant who requested the rezoning) shall schedule a public hearing to grant an extension, detemline compliance with the schedule for development, or cause the property to revert to its [om1er zoning classi fication. This action is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, ] 1-832. WHEREAS, the notice of hearing was published in The Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on August 22, 2004, and was posted on August 20,2004, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
