A RESOLUTION SETTING FORTH A REZONE OF A PORTION OF PARCEL 25-6, MOUNTAIN
VISTA RANCHES, PHASE II, IN SECTION 25, TOWNSHIP 24 NORTH, RANGE 15 WEST,
FROM A-R/36A (AGRICUL TURAL-RESIDENTIAL/TI-IlRTY-SIX ACRE MINIMUM LOT SIZE)
ZONE TO A-R/5A AND A-Rl15A (AGRICULTURAL-RESIDENTIAL/FIVE AND FIFTEEN ACRE
MINIMUM LOT SIZE) ZONES, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE
COUNTY, ARIZONA.
WHEREAS, at the regular meeting ofthe Mohave County Board of Supervisors held on October
4,
2004, a public hearing was conducted to determine whether approval should be granted
to Rezone the above-
described property as requested by R. W. Holmquist and Associates of Kingman, Arizona
representing David
Montana of Los Angeles, Cali fornia, and
\VHEREAS, this property is located nOlth of State Highway 66 and south of Brooks Boulevard.
The
site is accessed from State Highway 66 via north on Antares Road to Huntington Drive,
then west on
Huntington Avenue to Benjamin Road, then south on Benjamin Road to Brooks Boulevard,
then west on
Brooks Boulevard approximately one-quarter (~) mile to the northeast portion of the
property. The property
is vacant, and the terrain is generally flat, sloping slightly to the northwest. The
surrounding land uses
consist o I' vacant lots and scattered single-family residences. There are no significant
drainage patterns, and
\VH ERE AS, the appl icant requests this zone change to allow for the creation 0 I'
residential parcels.
The applicant proposes to divide the 38.27-acre parcel into four 5-plus acre parcels
and one IS-plus acre
parcel. The Mohave County General Plan designates this area as a Rural Development
Area, and
\VHEREAS, a review ofFEMA FIRM Panel #040058-2025B indicates the parcel described to
be in
Zone C, not in the Special Flood Hazard Area, and
WHEREAS, this item was continued at the August 11, 2004 Plmming and Zoning Commission
meeting at the request 0 I' the applicant's representati ve because he was unable to
attend the hearing, and
\VHEREAS, the following described Findings of Fact are for the above-captioned item:
a.
All notices have been advertised and posted according to regulations.
b.
The proposed action and effect comply with the Mohave County General Plan.
c.
The site is adequate for the action intended, and the use is consistent with the surrounding
land uses and terrain.
d.
The neighboring area contains other land uses similar to the above-proposed action.
e.
The site has legal access.
f.
There are no significant environmental features affecting the site.

. WHEREAS
, at the public hearing before the Mohave County Planning and Zoning Commission
on September 8, 2004, the Commission recommended APPROV AL for a Rezone subject to the
following:
1. The nOlihem portion of this property will be rezoned A-R/5A (Agricultural-Residential/Five
Acre Minimum Lot Size), and the southern portion of this property will be rezoned A-R/15A
(Agricultural-Residential/Fifteen Acre Minimum Lot Size). No more than five parcels may
be created with this rezone action.
') The submittal and recordation ofa Parcel Plat prepared in accordance with Chapter 7, Minor
.:-.
Land Divisions, of the Mohave County Land Division Regulations and 102.01-03 of the
Standard Specifications and Details is required.
^' The existing roadway easements, known as Brooks Boulevard and Jennings Road, shall be
-' .
dedicated to Mohave County on behalf of the public and accepted by the Mohave County
Board of Supervisors as road right-of-way and for utility purposes at a width ono feet.
The
south and east 30 feet orthe parcel shall be dedicated to Mohave County on behalfofthe
public and accepted by the Mohave County Board of Supervisors as road right-of-way and
for utility purposes. In addition, a twenty-foot (20') radius curve is required at all
dedicated
roadway intersection points.
4. All rights-or-way dedicated and public easements granted on the Parcel Plat will be accepted
by the Board of Supervisors upon Parcel Plat recordation.
5. Each parcel shall meet or exceed its respective acreage exclusive of roadways.
6. Each parcel shall havc legal access.
7. The applicable Dood zone(s) shall be noted on the Parcel Plat.
8. The appropriate zoning, building, environmental, and floodplain pellllits will be obtained
prior to construction. The permits wi 11 not be issucd until Parcel Plat recordation.
9. The Rezone shall not become effective until at least thirty (30) days after final approval
of
the change in elassi fication by the Board of Supervisors, as per ARS 11-829E.
10. Ifthe required Parcel Plat prepared in accordance with Chapter 7, Minor Land Divisions,
of
the Mohave County Land Division Regulations and 102.01-03 of the Standard Specifications
and Details is not recorded within one (1) year of Board of Supervisors approval, this
rezone
approval will be void.
All other conditions are to be met upon the development of the
property. Before the approval is declared void, the Board of Supervisors (after notification
by registered mai I to the owner and the applicant who requested the rezoning) shall schedule
a public hearing to grant an extension, determine compliance with the schedule for
development, or cause the property to revert to its ronner zoning classification. This
action
is in accordance with Arizona Revised Statutes Annotated, Title 11, Chapter 6, 11-832.

of
general circulation in Kingman, Mohave County, Arizona, on Septcmber 19, 2004, and
was posted on
Septcmber 17,2004, as requircd by Arizona Revised Statutes and the Mohave County Zoning
Regulations.
NO\V THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting
on Monday, Octobcr 4,2004, APPROVED this Rezone as recommended by the Mohave County
Planning
and Zoning Commission and outlincd herein.
