HomeMy WebLinkAbout02/03/2003 Item 013 .. :.~ RESOLlJTION NO. 2()()3-4S A RESOLlfTION SETTING FORTI-J THE APPROVAL OF A lVIIl\'OR AMENDMENT TO THE LONG MOUNTAIN AREA PLAN FOR A PORTION OF THE SEI,lj OF SECTION 14, TOWNSHIP 22 NORTH, RANGE 16 \VEST, TO CHANGE THE LAND USE DESIGNATION FROM RR/SA (RURAL RESIDENTIAL/S-ACRE MINIMUM LOT SIZE) TO RR/IA (RURAL RESIDENTIAL/l- ACRE MINIMUM LOT SIZE), IN THE MOHA VE COUNTY GENERAL AREA, MOHA VE COUNTY, ARIZONA. \VHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on February 3,2003. a public hearing was conducted to detennine whether approval should be granted to amend the Long Mountain Area Plan for the above-described property as requested by the Mohave County Planning and Zoning Department, of Kingman, Arizona, and \VHEREAS, this property is located on the northwest side of Arizona Highway 66 [Old Route 66] approximately two and one-half (21;i) miles northeast of Thompson A venue. The property has one singlc- family residence and other accessory buildings on it. The surrounding land uses consist of vacant lots and several single-family residences to the northeast along "66" Business Frontage Addition, Unit 3. There are no significant drainage patterns, and WHEREAS. Mohave County requests this amendment to the Area Plan to provide for RR/I A (Rural Residential development I-acre minimum lot size) land uses in place of AR/5A (Rural Residential development 5-acre minimum lot size). A portion of this area was rezoned to A-R/2A for two-acre parcels in 1997 via BOS Reso. No. 97-199. This zoning district does not conform to the Long Mountain Area Plan. ~ ~ An owner of the adjoining property is currently proposing to create one-acre parcels. The Area Plan Amendment will allow these properties to be rczoned Agricultural-Residential (A-R) and permitted for single-home constmction and bring the 1997 rezoning into conformance with the Area Plan. The Mohave County General Plan designates this area as Suburban Development Area, and \VHEREAS, a review off-EMA FIRM Panel #040058-26058 indicates the parcel described to be in Zone C. not in the FEMA Special Flood Hazard Area, and \VHEREAS, the following described Findings of Fact are for the above-captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect comply with the MohaV(~ County General Plan and other parts of the Long Mountain Area Plan. /3 , .. -, RESOI,UTION NO. 2003-48 PAGE 2 c. The site is adequate for the action intended and the use is consistent with the surrounding land uses and terrain. d. The neighboring area contains other land uses similar to the above-proposed action. e. The site has legal access. 1'. There are no significant environmental features affecting the site. 'VHEREAS. at the public hearing before the Mohave County Planning and Zoning Commission on January 8, 2003, the Commission recommended APPROVAL for the Long Mountain Area Plan Minor Amendment subject to the following: 1. The first 300 feet of frontage, as measured perpendicularly from the Arizona High\vay 66 right-of-way. will receive the Rural Residential/One-Acre minimum lot size land use designation as shown on Exhibit" A". WHEREAS. the notice of hearing was published in The Standard, a newspaper of general circulation in Kingman. Mohave County, Arizona, January 15, 2003, and posted January 17, 2003, as required by Arizona Revised Statutes and the Mohavc County Zoning Regulations. NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their meeting on Monday, February 3, 2002, APPROVED this Minor Area Plan Amendment as recommended by the Mohave County Planning and Zoning Commission and outlined herein. Box 7000 Kingman, AZ 86402-7000 RE: Request for comments on a proposed amendment to the Long Mountain Area Plan for a portion of the SE 1/4 of Section 14, T.22N, R.16W. Dear Mr. Davidson: The Kingman Planning and Zoning Department has reviewed the above referenced case submitted to us in your letter of December 20, 2002, and we offer the following comments: The proposed change to the Long Mountain Area Plan would involve changing the land use designation of the subject property along the north side of Highway 66 from RR/5A (Rural Residential - 5 acre minimum lot size) to RR/IA (Rural Residential- I acre minimum lot size). The current Kingman General Plan 1990-2010 indicates that this area is designated for Rural Density Residential use (less than 1 dwelling unit per acre) (see enclosed). As part of the update of this plan required under the Growing Smarter legislation, the Kingman Planning and Zoning Commission recently recommended some changes to the General Plan land use map. The commission has recommended a Community Commercial node, which includes the northern portion of the subject property. The southern portion of the subject property is recommended for Low Density Residential (1-2 dwelling units per acre). Frees Wash crosses between these areas according to area topographic and aerial maps. The wash itself has been recommended for open space preservation on the land use map. Please see the enclosed map for details. The recommendations on this map and the rest of the proposed General Plan are scheduled for a final review by the Kingman Planning and Zoning Commission in April, 2003 with these final recommendations scheduled for City Council review and possible approval in June, 2003. The plan itself may be scheduled for approval by the voters as early as November, 2003. We have no objections to the proposed change in the land use designation. Please note that water service requests to any existing or new parcels that are created will need to be reviewed by MUC and approved by the Kingman City Council.
