A RESOLUTION SETTING FORTH. A REZONE OF LOT 3, aLOCK I, GOLDEN SAGE
RANCHOS, UNIT 55, IN SECTION 11, TOWNSHIP 21 NORTH. RANGE 18 WEST,
FROM
C-2H/IA (GENERAL COMMERCIAL HIGHWAY FRONTAGE/ONE ACRE MINIMUM LOT
SITE) ZONE TO C-2H (GENERAL COMMERCIAL HIGH\VAY FRONTAGE) AND R-l
(SINGLE-FAMILY RESIDENTIAL) ZONES, IN THE GOLDEN V ALLEY AREA, MOHA
VE
COUNTY, ARIZONA.
WHEREAS, at thc regular meeting of the Mohave County Board of Supervisors
held on
October 6, 2003, a public hearing was conducted to detennine whether
approval should be granted to
Rezone the above-described property as requested by Roger Hubbell
and Victoria Horsch of Golden
Valley, Arizona, and
\VHEREAS, this property is located south of State Highway 68 between
Aztec Road and Bacobi
Road. The site is accessed directly from State Highway 68 via south
on Hano Road. The property is
located on the southwest comer of Hano Road and State Highway 68.
The property has a commercial
business on the northern portion and a single-family residence on
the southern portion. The terrain is
relatively flat sloping slightly to the southwest. The surrounding
land uses consist of vacant lots, several
commercial businesses and single-family residences. There are 110
significant drainage patterns, and
WHEREAS, the applicant requests this zone change to allow for continuing
thc commercial use
on the northern portion and to have a single-family residence on
the southern portion.
The applicant
proposes to divide the I.S8-acre parcel into two parcels.
The nOlihem one acre will remain zoned
C-2H/1 A (General Commercial Highway Frontage/One Acre Minimum Lot
Sitc) and the southern 0.58-
acre will be rezoned R-l (Single-Family Residential).
The Mohave County General Plan and the
Golden Valley Area Plan both designate this area as a GC (General
Commercial), and
WHEREAS, a revie\v of FEMA FIRM Panel #040058-231 OC indicates the
parcel described to
be in Zone C, not in the Special Flood Hazard Area, and
\VHEREAS, the Arizona Department of Transportation (ADOT) will not
allow direct access
onto State Highway 68, all access shall be from Hano Road, and
\VHEREAS, the southern portion of this property is in violation
of the Mohave County Zoning
Ordinance for open-lot storage/junkyard, and
WHEREAS, the following described Findings of Fact are for the above-captioned
item:
a.
All notices have been advertised and posted according to regulations.

b.
The proposed action and effect comply with the Mohave County General Plan and the
Golden Valley Area Plan.
c.
The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d.
The neighboring area contains other land uses similar to the above-proposed action.
e.
The site has legal access.
f.
There arc no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning
and Zoning Commission
on September 10, 2003, the Commission recommended APPROVAL [or a
Rezone subject to the
following:
1.
The northem one acre will remain zoned C-2H/lA (General Commercial Highway
Frontage/One Acre Minimum Lot Site) and the southern 0.58 acre will be rezoned R-I
(Single-Family Residential).
2.
The submittal and recordation of a Parcel Plat prepared in accordance with Chapter 7,
Minor Land Divisions of the Mohave County Land Division Regulations which became
effective on March 19,2001, and 102.04-B of the Standard Specifications and Details is
required.
3.
The Arizona Department of Transportation (ADOT) will not allow direct access onto
State Highway 68; all access shall be from Hano Road.
4.
The zoning violation must be corrected within 30 days of Board of Supervisors approval.
5.
A 20-foot radius curve at the intersection of State Highway ()8 and Hano Road shall be
dedicated to Mohave County on behalf of the public and accepted by the Mohave County
Board of Supervisors as road right-of-way.
6.
The eight feet adjoining to all rights-of-way shall be granted to the public as a public
utilities easement (PUE).
7.
Each parcel shall meet or exceed its respective acreage exclusive of roadways.
8.
Each parcel shall have legal access.
9.
The applicable flood zone(s) shall be noted on the Parcel Plat.
10.
The appropriate zoning, building, environmental and 1100dplain pem1its will be obtained
prior to constmction. The permits will not be issued until Parcel Plat recordation.
11.
The Rezone shall not become effective until at least 30 days after final approval of the
change in classification by the Board of Supervisors, as per ARS 11-829E.

12.
If the req uired Parcel Plat prepared in accordance with Chapter 7, Minor Land Divisions
of the Mohave County Land Division Regulations which became effective on March 19,
2001 and 102.04-B of the Standard Specifications and Details is not recorded within one
year of Board of Supervisors approval, this rezone approval will be void.
A 11 other
conditions are to be met upon the development of the property. Before the approval is
declared void, the Board of Supervisors (after notification by registered mail to the owner
and the applicant who requested the rezoning) shall schedule a public hearing to grant an
extension, deternIine compliance with the schedule for development, or cause the
propeliy to revert to its fornler zoning classification.
This action is in accordance with
Arizona Revised Statues Annotated, Title 11, Chapter 6, 11-832.
WHEREAS, the notice of hearing was published in The Standard, a
newspaper of general
circulation in Kingman, Mohave County, Arizona, on September 17,
2003, and was posted on
September 19, 2003, as required by Arizona Revised Statutes and
the Mohave County Zoning
Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at
their regular
meeting on Monday, October 6, 2003, APPROVED this Rezone as recommended
by the Mohave
County Planning and Zoning Commission and outlined herein.
