Even before our recent new "Growing Smarter" planning additions were added to the l\10have County General Plan, sensitive areas like Elements Canyon were reviewed for environmental compatibility to the increased density that down zoning creates. How many subdivisions have at there center a traditional cattle ranch operation, that also is a hub for federally protected wild horses? Hardly any are in small catlyons. Hopefully all of you have carefully reviewed the "Growing Smarter" additions and like many of us welcome them for the balanced contribution to good development planning they offer. Mohave County needs to catch i.ts breath aLld as the state over seeing agency states, lets "grow smarter". Part of that must include the recognition of the Public TtTIst Doctrine that requires county services to county approved subdivisions. The roads in this subdivision are single lanes in places because they are in the main mountain wash and in our 5 years living up this canyon we've never witnessed the pleasant effects of a county road graded on these county roads. Increasing the density makes the situation much worse and is against any growing smarter intent. The water situation continues to worsen with the latest well drilling attempt by previous re-zone applicant coming up dry. People have had to haul water and now this latest dry well. The main sales subdivision sign on Stockton Hill Road says "shallow water", apparently not so. That is why A.R.S. 45-453, states ground water maybe drawn for "reasonable and beneficial use". And A.R.S. 45- 108 states wells must be registered and subdivisions are subject to the "adequate water supply program". Prior to recording a plat map, the developer of a proposed subdivision must submit a plan to A,D,W.R that demonstrates the adequacy of the water supply to meet the needs projected by the developer. A. D. W.R - AZ Dept of Water Resources of the proposed plan, determines if there is sufficient water to meet all of the proposed uses in the subdivision and this included the needs of the existing users such as the ranchers, for 100 years. After A.D. \\t'. R. makes their detetmination that the subdivision has an adequate or is in adequate water supply, the findings are forwarded to the Real Estate Commissioner and then itis required ... . ..,.. , , to be in all promotional materials and contracts for the sale of any of the property. This Alizona La,,,, is to protect consumers and is an affirmative duty of the Mohave County officials under the Public Trust Doctrine. Mohave County government is not to just keep approving more and more subdivisions, hut needs to include these considerations. We request an opinion from Planning and Zoning staff and the Mohave County Attomey regarding our concems and request a "stay" of further subdividing in Elements Canyon, until these concern~ are addressed. Also in tnis process we are requesting a re-review of Elements Canyon as a separate element of the Long Mountain Plan. The Cerbat Mountain range that Elements Canyon is a pmt of, is lUliquely different in resources in all regards, than the major valley portion of the Long Mountain plan. Mohave County area plan map designates this rural area density one d"velling unit per 36 unlts. Trying to use the Long Mountaitl Plan in a blanket approval for Elements Canyon is not appropriate and is why it needs the special consideration we are requesting.
