XC: RESOLUTION NO. 2009 -252 A RESOLUTION SETTING FORTH A ZONING USE PERMIT ON THE SW 1/4 SW 1/4 OF PARCEL 8, FRANIII CHAPARRAL ESTATES, IN SEC'T'ION 11, TOWNSHIP 39 NORTH, RANGE 16 WEST, FOR A WATER TREATMENT PLANT, IN AN A -R/10A (AGRICULTURAL- RESIDENTIAL/TEN ACRE MINIMUM LOT SIZE) ZONE, IN TIIE ARIZONA STRIP AREA, MOHAVE COUNTY, ARIZONA. WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on October 5, 2009, a public hearing was conducted to determine whether a Zoning Use Permit should be granted for the above- described property as requested by Michael T. Black, a managing member of Mesquite Arizona, LLC, of L,as Vegas, Nevada, and WHEREAS, this property is located west of Scenic Boulevard between Toni Drive and Shirley Drive. The site is accessed from Interstate 15, via Old Highway 91, then northeasterly on Old Highway 91 to Scenic Boulevard, and then south on Scenic Boulevard to Shirley Drive, and then west on Shirley Drive to the property located on the northeast corner of Shirley Drive and Zion Park Road. The property is vacant. The terrain is relatively flat, generally sloping north towards the Virgin River. The surrounding land uses consist of vacant land and scattered single family residences. 'there is a minor wash in the center of the property, and WHEREAS, the applicant requests this Zoning Use Permit to allow for a water treatment plant in accordance with the Mohave County Zoning Ordinance, Section 27.A, General Provisions, Special Uses. The requested water treatment plant will provide clean and safe drinking water to local residents, and will be operated by Sunrise Utilities. The proposed facility is expected to service approximately 600 homes and has a service capacity of approximately 150,000 gallons per day. The Certificate of Convenience and Necessity (CC &N) for Sunrise Utilities is currently under review by the Arizona Corporation Commission (ACC). Minor Plan Amendments accompany this Zoning Use Permit and if approved would change the land use designation to both the Mohave County General Plan and the Virgin River Communities Area Plan from Urban Development Area, Low Density Residential to Urban Development Area, Light Industrial, and WHEREAS, the site is within the Littlefield Fire District. The site will be served by a private well. The site is served by electric power and telephone service. Shirley Drive and Zion Park Road are not paved and are not on the County's road maintenance system, and RESOLUTION NO. 2009 -252 PAGE 2 WHEREAS, Section 27.A, Special Uses, of the Mohave County Zoning Ordinance provides a water treatment plant shall be permitted if it is deemed essential and desirable to the public convenience or welfare, and is considered to be in harmony with the various elements and objectives of the General Plan, and WHEREAS, the Mohave County Environmental Health Division advises that wastewater disposal must meet all current, applicable State laws, local policies, and ordinances, including any applicable subdivision approvals, requirements, or restrictions. Depending on the type of facilities that are eventually built on these parcels and the amount of sewage flow, an alternative system may need to be designed to meet current nitrogen loading rules. If an on -site wastewater system is applied for, it will be the responsibility of the applicant to prove, to the Environmental Health Division, that the discharge of wastewater from the proposed residence or facility will not violate any water quality standards. Studies may need to be completed including, but not limited to, site investigation (soils evaluation/characterization and /or percolation testing) and a nitrogen loading study, and WHEREAS, historically, the Virgin River Communities area has lacked the necessary infrastructure to support its growing population due to the rural character of the area, the diverse nature of the terrain, and the isolation of each community. Those factors together would seem to preclude the need for a sophisticated public infrastructure system. Since the adoption of the Virgin River Communities Area Plan, the area has experienced a large population growth. The increased population has lead to a higher demand for public infrastructure which can be attributed to the area's improved economy, and increased tourism and workforce, and WHEREAS, the area plan also provides that the Virgin River communities are on the verge of an explosion of development and population increase. Economic factors in Mesquite have created pressure on the communities for the provision of housing, water, sewer service, and flood control. An increased labor force is searching for affordable housing and services and is putting great pressure on the communities to provide those amenities. The area has become popular for tourist and winter visitors, adding more pressure. There are proposed residential and commercial developments in all five communities. It is now imperative that measures be taken immediately to improve public infrastructure, solid waste removal, and flood control, and WHEREAS, the Mohave County General Plan states that the Location of development has a significant impact on the demands for public facilities and services, the costs of infrastructure construction and the cost effectiveness of public service provision. A sprawling, low density development pattern is more costly to serve than is a compact pattern. Development within areas that are already adequately served reduces the need for expensive extensions of facilities to new areas. For these reasons, the land use plan for a community has important implications for the quality and cost of public services available to its residents, and WHEREAS, Policy 10.5 of the Mohave County General Plan provides the County shall use its planning and development regulations to protect residential neighborhoods from encroachment of incompatible activities or land uses which may have a negative impact on the residential living environment, and RESOLUTION NO. 2009 -252 PAGE 3 WHEREAS, Policy 11.7 of the General Plan states that Mohave County shall only approve requests for rezoning, special permits, the division of land, other new development proposals or public projects that are consistent with the Land Use Diagrams, the policies contained in the Land Use Element and the other Elements of this General Plan, as further set forth in the County's Development Regulations, and WHEREAS, Policy 40.1 of the General Plan provides that Mohave County should use its zoning regulations to promote growth in or adjacent to existing urban and suburban areas where adequate public facilities are available, and WHEREAS, Policy 40.2 of the General Plan provides that Mohave County shall encourage infill development of urban and suburban areas where existing public facilities are adequate to meet the demands of such development, and WHEREAS, Policy 40.3 of the General Plan provides that Mohave County shall designate areas within Urban Development Areas and Suburban Development Areas that are appropriate for development based on proximity of public services and facilities. New urban or suburban development that is not in one of these designated areas may be approved if the developer provides adequate public facilities, and WHEREAS, a review of FEMA FIRM Panel 4040058 -0200B indicates the parcel described to be in Zone C, not in the Special Flood Hazard Area, and WHEREAS, the following described Findings of Fact are for the above captioned item: a. All notices have been advertised and posted according to regulations. b. The proposed action and effect comply with the Mohave County General Plan and the Virgin River Communities Area Plan. C. The site is adequate for the action intended and the use is compatible with the surrounding land uses and terrain. d. The section does not contain other land uses similar to the above proposed action. e. The site has legal access. f. There are no known significant environmental features affecting the site, except the noted wash. WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on September 9, 2009 the Commission recommended APPROVAL for a Zoning Use Permit subject to the following: 1. This Zoning Use Permit is for a water treatment plan and the activities related thereto. RESOLUTION NO. 2009 -252 PAGE 4 2. The applicant shall comply with all the applicable provisions of the Mohave County Zoning Ordinance. A site plan prepared in accordance with Section 27.P (Site Plan Requirements) must be completed and approved prior to approval of permits and before establishing the use. In addition, the applicant will provide a view- obscuring fence as required by Section 27.H of the Mohave County Zoning Ordinance prior to establishing the use. 3. The applicant shall submit a water treatment plant for review to the Arizona Department of Water Quality (ADWR) and the Arizona Department of Environmental Quality (ADEQ). A copy of all approved permits shall be submitted to Mohave County. 4. The appropriate zoning, building, environmental, and floodplain permits will be obtained prior to construction. 5. If construction or the use has not commenced within two years of Board of Supervisors approval of the Zoning Use Permit or if the use has been discontinued for six months, then approval shall terminate at that date. 6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board of Supervisors if, in the opinion of the Commission and the Board, the continued uses of the property would be contrary to the public health, safety and welfare. WHEREAS, the notice of hearing was published in The Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on September 20, 2009, and was posted on September 18, 2009, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations, NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, October 5, 2009, APPROVED this Zoning Use Permit as recommended by the Mohave County Planning and Zoning Commission and outlined herein. The one is for Mesquite AZ L.L.0 on parcel 402- 77 -008A and the other is for Melvin and Wendy Weasa on parcel 402 -26 -021. The owners will need to submit to me drawings of what they are proposing in order to extend power off of the existing infrastructure. The costs involved with extending the power will be paid for by the owner. Thanks for your help.
