HomeMy WebLinkAbout3-1E Ct C, -- Administrative Procedures (3 -1) ADMINISTRATION BUILDING & FACILITIES RULES & POLICIES .p 1R Responsible Department: Administration / Effective Date: March 1, 2010 Signed: Revision Date: Ron Walker, County Manager AUTHORITY: Mohave County Board of Supervisors Ordinance No 1991 -1, revised May 19, 1997 and June 1, 1998, relating to County Government Administration; delineating authority, responsibilities and duties of County Manager. PURPOSE: To identify and outline the rules and policies the county will follow with regard to the Mohave County Administration Building, located at 700 W. Beale Street, Kingman, Arizona. The premises covered includes the building, the parking lots, the driveways leading from the dedicated public streets to the parking lots and the building, and the sidewalks leading from the parking lots and driveways to the Building. It also includes landscaped and undeveloped areas adjacent to the parking lots and building. It does not include publicly dedicated areas within or adjacent to Route 66 /Andy Devine Avenue or Beale Street. SCOPE: These restrictions apply to everybody, including without limitation the public, visitors, government officials, agents and employees. Anyone who violates these rules will be subject to removal from the premises. If that person refuses to leave, law enforcement officials may take any necessary steps within their discretion in accordance with Arizona laws, including but not limited to arresting the person for disorderly conduct (ARS 13- 2904), or obstructing government operations (ARS 13- 2402). POLICY: The Mohave County Administration Building and Facilities are maintained and held open to the public solely for the conduct of official government business. The public is invited to visit the offices of the officials, agents and employees within the building for the conduct of official government business. The Board of Supervisors Auditorium and other meeting rooms within the building are to be used by the Board of Supervisors, Planning and Zoning Commission and other public agencies and commissions for public meetings and workshops as required or permitted by law. These rooms may also be used by county employees, departments, and committees for public and private meetings as required or permitted by law. As availability and resources permit, the rooms may also be used by other federal, state and local governmental entities and agencies for the conduct of official business. This includes use by elected or appointed federal, state and local incumbents for communication with constituents. The Mohave County Administration Building and Facilities is not a public forum. In order to protect the safety of its employees and visitors, preserve partisan and political neutrality in the provision of government services, promote efficient use of taxpayer resources, and reserve the building and facilities for its intended purpose, certain conduct must be restricted. Nothing in these rules will be construed to prevent the use of the premises for communication or dissemination of information to the public by government officials or employees as otherwise authorized by law. Nothing in these rules is intended or will be construed as Page 1 of 3 Administrative Procedures (3 -1) ADMINISTRATION BUILDING & FACILITIES RULES & POLICIES denying anyone the civil and political liberties guaranteed by the United States and Arizona Constitution as interpreted and applied by the State and Federal Courts. In the event that any rule or portion thereof is found to be unenforceable, the remainder will remain in full force and effect. PROHIBITED ACTIVITIES: No part of the Administration Building and Facilities may be used for the following purposes: 1. Political campaigning, including solicitation either in support of or against a political candidate, or potential political candidate, an issue before or potentially before the voters or an incumbent government official or employee. This provision does not prohibit the expression of personal opinions or beliefs if done in a manner that does not disrupt the business conducted within the premises. 2. Distribution of or gathering signatures on petitions including nomination, referendum or recall petitions. 3. Solicitation of campaign contributions. 4. The erection or display of campaign signs or banners. Provided that this provision will not prohibit a political sign of reasonable size attached to or painted on a vehicle, while the vehicle is parked on the premises for the legitimate conduct of government business. This provision will also not prohibit the wearing of campaign buttons or apparel in support of or against a candidate or issue while the wearer is on the premises for the conduct of legitimate government business. 5. Leafleting or distribution of material either in support of or against a candidate or an issue before the voters. 6. Political assembly, rallies, demonstrations or picketing. No Solicitation: No part of the Administration Building and Facilities may be used for the following purposes. 1. Vending or sales of products, goods or services except as permitted by County Administration. 2. Rallies, demonstrations, picketing or assembly, whether for political, commercial or personal purposes. 3. Solicitation of funds. 4. Leafleting or distribution of flyers or other literature. 5. Parades, fairs, exhibits, except as permitted by County Administration. Page 2 of 3 Administrative Procedures (3 -1) ADMINISTRATION BUILDING & FACILITIES RULES & POLICIES 6. Erection or display of signs or banners. Disruptive Activity: The Mohave County Administrative Building and Facilities are maintained for the orderly conduct of official government business. Anyone who engages in disruptive activity or who directs or incites others to engage in disruptive activity will be subject to removal from the premises and or prosecution in accordance with Arizona law. Disruptive activity includes the following conduct: 1. Unlawful assembly as that term is defined by ARS 13 -2902. 2. Rioting, as that term is defined by ARS 13 -2903. 3. Disorderly conduct as that term is defined by ARS 13 -2904. 4. Loitering as that term is defined by ARS 13 -2905. 5. Impeding the orderly flow of pedestrian or vehicular traffic. 6. The use of foul and offensive language and gestures. 7. Any conduct, including threats or the display of weapons or implements, which could reasonably be viewed as frightening, upsetting or intimidating by a person of ordinary sensibilities. Weapons: The Mohave County Administrative Building and Facilities are maintained for the orderly conduct of official government business. In order to protect the public safety and welfare of staff and visitors alike 1. No deadly or dangerous weapons of any type that could cause injury are permitted in the building. See Administrative Procedure Firearms or Deadly Weapons Prohibited in County Administration Complex (3 -6).
