Bettwy, State Land Commissioner of th" State of Arizona, Appellants v. Bonelli Cattle Company, a California Corporation, A1Jp llee, filed on October 4, &971, and; HHEREAS, the Mohave Board of Supervisors believe the decision wil seriously and adversely affect the land titles in the area of Mohave County adjacent to the Colorado River and will hamper the ability of land owners in the area of Mohave County adjoining the Colorado River in obtaining title in surance, and; ¡lliEREAS, the Mohave County Board of Su1Jervisors is of the opinion that the decis1òon of the Arizona Supreme Court, results in a taking of the property of Bonelli Cattle Company wj~thout com1Jensation, and the effect of th ruling of the Arizona Supreme Court ',lOuld be to take the pro1Jerty of others similarly situated to Bonelli Cattle Company, and; HHEREAS, the economic development of Mohave County is dependent upon the development of the recreational potential of the Colorado River and the man-made lakes upon the Colorado River in !1ohave County, and that it is the opinion of the !1ohave County Board of Sùpervisots that it is advis~Jle that as much as possible of the land fronting upon the Colorado River Demain n private ownership. There are ap"Droximately fourteen miles of privately owned land fronting upon the Colorado in M",have County, and the effect of the decision of the Arizona Suprenæ Court will reddce this by apprm,imately seven miles and possibly by as much as eleven miles; VfrlEREAS, the Mohave County Board of Supervisors, is extremely con- cetn,ed with the serious adverse effect the decis1Íion of the Arizona Supreme Court will have upon the tax base of Mohave County and upon the trem,endous growth in population and assessed value Mohave Count;y has experienced in the area of Hohave County adjacent to the Colorado River. -;;¡Ol- Page 1 , . .' HHEREAS, as the Hohave County Board of Stmervisors is aware that much of the private lómd adjacent to the Colorado River in !1ohave County has been subdivided and sold in good faith by the d,evelopers to individuals and that the decision of the Arizona SuDrew~ Court will result in the loss, by these individuals residents of Hohave County of the land purchased; In one subdivision alone theTe are ninty-four lots which will be taken by the State of Arizona; ÍtffiEREAS, the Hohave Indian's are attempting to develop the Ft. Mohave Indian Reservation and that this development will be to the best interest of the County of l'fohave and th", decision of the Arizona Supreme Court will adversely affect the title to a substantial portion of the river frontage ,of the Ft. Hohave Indian Reservation:: NOH THEREFORE, BE IT RESOLVED that the Hohave County Board of Supervisors hereby authorizes and directs the Hohave County Atto=ey to take the appropriate a~tion to attempt to have the decision of the Arizona Supreme CO1jlrt r"versed and the opinion of the Court of Appe~ls as set forth in 11 Ariz.
