AN ORDINANCE SETTING FORTH AN AMENDMENT TO SECTION 8, FEES, OF THE
MOHAVE COUNTY ZONING ORDINANCE, TO PROVIDE FEES FOR THE E (ENERGY
OVERLAY) ZONE AND ZONING USE PERMITS FOR ENERGY PROJECTS.
AMEND THE MOHAVE COUNTY ZONING ORDINANCE AS FOLLOWS:
Section 8 FEES
All fees shall be payable to the Mohave County Planning and Zoning Development Services
Department.

A RESOLUTION SETTING FORTH THE ADOPTION OF MOHAVE COUNTY ORDINANCE
NO. 2009-11, AMENDMENT TO SECTION 8, FEES, OF THE MOHAVE COUNTY ZONING
ORDINANCE, TO PROVIDE FEES FOR THE E (ENERGY OVERLAY) ZONE AND ZONING
USE PERMITS FOR ENERGY PROJECTS.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on
November 16, 2009, a public hearing was conducted to determine whether approval should be granted to
establish fees for applications for the Energy Overlay zone and for Zoning Use Permits for energy
projects, as requested by the Mohave County Development Services Department, and
WHEREAS, the State of Arizona and Mohave County have taken the position that development
of alternative energy programs is an important goal, and the Department has been directed to identify
changes to County Ordinances and Regulations necessary to accommodate this type of development.
Amendments to the Mohave County Zoning Ordinance (the Ordinance) were approved by the Board of
Supervisors on June 1, 2009, with BOS Resolution No. 2009-139 to allow alternative energy projects
with a Zoning Use Permit. Accompanying amendments propose to establish a new Energy Overlay
Zone classification, and other related amendments necessary to implement it, and
WHEREAS, the nature of alternative energy projects requires the use of substantially larger
acreages with less density of development than conventional fossil fuel power plants. As a result, the
cost associated with posting notice of these projects can be substantially higher than for rezones of
smaller parcels. The requirements for posting of a property for a rezone are established in A.R.S. § 11-
829,which requires at least one notice for each quarter mile of frontage along perimeter public rights-of-
way, and
WHEREAS, the Department proposes an application fee similar to the fee established for
Specific Zoning Plans, which also generally involve large areas similar to those required for an
alternative energy project. As proposed, the fee for the rezoning of a 50-acre parcel would equal the
current cost of a rezone of 10 or more acres to a commercial or industrial use. After that, the fee would
increase incrementally at the rate of $2 per acre. The base fee of $900 is substantially less than the
current $1,500 base fee for a Specific Zoning Plan; however, the alternative energy rezone would
generally not include the extensive review of what would essentially be a new zoning ordinance and a
development agreement that would be involved with a Specific Zoning Plan. A Zoning Use Permit is
proposed to have a fee equal to the fee for a commercial Zoning Use Permit plus the incremental $2 per
acre, and

WHEREAS, the language to be added has been bolded. The language to be deleted has been
struck, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on October 14, 2009, the Commission recommended APPROVAL for the amendment contained in the
attached Ordinance, and
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, on November 1, 2009, and was posted on
October 30, 2009, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on
Monday, November 16, 2009, ADOPTED Mohave County Ordinance No. 2009-11, amending Section
8, fees, of the Mohave County Zoning Ordinance, to provide fees for the E (Energy Overlay) zone and
Zoning Use Permits for energy projects, as recommended by the Mohave County Planning and Zoning
Commission and outlined herein.
