A RESOLUTION SETTING FORTH A RENEWAL OF A ZONING USE PERMIT ON THE
NORTH 570 FEET OF THE WEST 1,389.5 FEET, EXCEPT THE WEST 1,109.5 FEET OF THE
N 1/2 OF SECTION 22, TOWNSHIP 23 NORTH, RANGE 13 WEST, FOR A DOG KENNEL IN
AN A -R/36A (AGRICULTURAL- RESIDENTIAL /THIRTY -SIX ACRE MINIMUM LOT SIZE)
ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on
February 7, 2011, a public hearing was conducted to determine whether a Renewal of a Zoning Use
Permit should be granted for the above - described property as requested Ernest R. Schoop of A Place of
Hope Dog Rescue Foundation of Valentine, Arizona, and
WHEREAS, this property is located southeast of State Highway 66, approximately one mile
south of Valentine, Arizona. The site is accessed from State Highway 66 to an unnamed dirt road, then
east on the unnamed dirt road approximately six - tenths (0.6) of a mile to the southeast corner of the
property. The property has a single- family residence and an accessory building on it. The terrain is
gently rolling hills, sloping generally to the north. The surrounding land uses consist of vacant land.
There are no significant drainage patterns. The Mohave County General Plan designates this area as a
Rural Developnnent Area, and
WHEREAS, this Zoning Use Permit for the "A Place for Hope Dog Rescue Foundation" dog
kennel in an A -R/36A (Agricultural- Residential /Thirty -Six Acre Minimum Lot Size) zone was
conditionally approved by the Mohave County Board of Supervisors on January 7, 2002, via BOS
Resolution No. 2002 -019 for an initial period of three years, with subsequent renewals. It was renewed
for the first time with BOS Resolution No. 2005 -100 on March 7, 2005. It was renewed for a second
time with BOS Resolution No. 2008 -046 on February 4, 2008. The parcel contains 3.46 acres but
appears to have been created prior to the passage of P &ZC Resolution No. 87 -67 which down zoned this
property and those adjacent from A -R to A- R/36A. The total numbers of dogs have not changed since
the first Zoning Use Permit was issued. The applicant owns all of the parcels within a 300 -foot radius of
this property, and
WHEREAS, this Renewal will continue the approval of a dog kennel, as required by BOS
Resolution No. 2002 -019. The applicant requested this renewal in his application of November 23,
2010, and
WHEREAS, this will be the third Renewal for this property, and

WHEREAS, at this time there is no permit of record for a kennel with Environmental Health,
and
WHEREAS, a review of FEMA FIRM Panel #FCP- 2010 -00243 indicates the parcel described
to be in Zone X, not in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above - captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect comply with the Mohave County General Plan.
C. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The neighboring area does not contain other land uses similar to the above - proposed
action.
e. This request complies with the Renewal Policy.
f. There are no significant environmental features affecting the site.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on January 12, 2011, the Commission recommended APPROVAL for a Renewal of a Zoning Use
Permit subject to the following:
I . Compliance with the conditions of BOS Resolution No. 2002 -019.
2. This Renewal is approved for three years and expires March 7, 2014. An application
for another Renewal must be applied for prior to the expiration date.
3. The applicant shall comply with the requirements of the Mohave County Animal Control
Division. If the Mohave County Animal Control Division provides written notification to
the Mohave County Development Services Department that the kennel is not in
compliance with an animal control ordinance, and that the continued use would be
contrary to the public health, safety, and welfare, this Zoning Use Permit may be subject
to revocation as provided below.
4. The applicant shall comply with the requirements of the Mohave County Environmental
Health Division. If the Mohave County Environmental Health Division provides written
notification to the Mohave County Development Services Department that the kennel is
not in compliance with an environmental health ordinance, and that the continued use
would be contrary to the public health, safety, and welfare, this Zoning Use Permit may
be subject to revocation as provided below.
WHEREAS, the notice of hearing was published in The Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, on January 23, 2011, and was posted on
January 21, 2011, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular
meeting on Monday, February 7, 2011, APPROVED this for a Renewal of a Zoning Use Permit as
recommended by the Mohave County Planning and Zoning Commission and outlined herein.

1C. Evaluation of a request for a RENEWAL OF A ZONING USE PERMIT on the north 570
feet of the west 1,389.5 feet, except the west 1,109.5 feet of the N 1/2 of Section 22, Township
23 North, Range 13 West, for a dog kennel in an A -IV36A ( Agricultural - Residential /Thirty-
Six Acre Minimum Lot Size) zone, in the Mohave County General Area, Mohave County,
Arizona.
This evaluation is to determine whether a Renewal of a Zoning Use Permit should be granted for
the above - described property as requested Ernest R. Schoop of A Place of Hope Dog Rescue
Foundation of Valentine, Arizona.

d. The neighboring area does not contain other land uses similar to the above - proposed
action.
e. This request complies with the Renewal Policy.
f. There are no significant environmental features affecting the site.
STAFF RECOMMENDATION:
Staff recommends this request for a Renewal of a Zoning Use Permit be APPROVED subject to
the following:
1. Compliance with the conditions of BOS Resolution No. 2002 -019.
2. This Renewal is approved for three years and expires March 7, 2014. An application
for another Renewal must be applied for prior to the expiration date.
3. The applicant shall comply with the requirements of the Mohave County Animal Control

66], approximately one mile south of Valentine, Arizona. The site is accessed from State Highway 66
via east on an unnamed 'dirt' road approximately six - tenths (0.6) of a mile to the southeast corner of the
property. The property has a single- family residence and an accessory building on it. The terrain is
gently rolling hills, generally sloping to the north. The surrounding land uses consist of vacant land.
There are no significant drainage patterns, and
WHEREAS, the applicant requests this Zoning Use Permit to allow for a dog kennel in an A -R/
36A (Agricultural- Residential/Thirty -six Acre Minimum Lot Size) zone. The Mohave County General
Plan designates this area as a Rural Development Area. and
WHEREAS, a review of FEMA FIRM Panel 4040058 -2025B indicates the parcel described to
be in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the Public Works Department records do not show legal recorded access to this
site. The Department requests that proof of legal access be submitted prior to site plan approval. If
legal access does not exist at this time, a dedicated right -of -way or a granted access easement will have
to be obtained and recorded and a copy of the instrument be submitted prior to approval of the site plan,
and
WHEREAS, the following described Findings of Fact are for the above- captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect comply with the Mohave County General Plan.
C. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.

e. There are no significant environmental features affecting the site, except the noted
Special Flood Hazard Area.
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on December 12, 2001, the Commission recommended APPROVAL for a Zoning Use Permit subject to
the following:
1. This Zoning Use Permit is for a dog kennel in an A -R/36A (Agricultural -
Residential/fhirty -six Acre Minimum Lot Size) zone and the activities related thereto.
2. This Zoning Use Permit is approved for three years and expires JANUARY 7, 2005 An
application for an Extension of Time must be applied for prior to the expiration
date of the Board of Supervisors Resolution.
3. The applicant shall comply with all the applicable provisions of the Mohave County
Zoning Ordinance. A site plan prepared in accordance with Section 27Y (Site Plan
Requirements) must be completed and approved prior to approval of permits and before
establishing the use.
4. The appropriate zoning, building, environmental, and floodplain permits will be obtained
prior to construction.
5. If construction or the use has not commenced within one year of Board of Supervisors
approval of the Zoning Use Permit or if the use has been discontinued for six months,
then approval shall terminate at that date.
6. This Zoning Use Permit is subject to revocation upon 60 days notification by the Board
of Supervisors if in the opinion of the Commission and the Board, the continued uses of
the property would be contrary to the public health, safety and welfare.
WHEREAS, the notice of hearing was published in The Standard, a newspaper of general
circulation in Kingman, Mohave County, Arizona, on December 19, 2001, and posted on December 21,
2001, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular
meeting on Monday, January 7, 2002, APPROVED this Zoning Use Permit as recommended by the
Mohave County Planning and Zoning Commission and outlined herein.

WHEREAS, a review of FEMA FIRM Panel 4040058 - 2025B indicates the parcel described to
be in Zone A, in the Special Flood Hazard Area, and
WHEREAS, the following described Findings of Fact are for the above - captioned item:
a. All notices have been advertised and posted according to regulations.
b. The proposed action and effect comply with the Mohave County General Plan.

C. The site is adequate for the action intended and the use is consistent with the surrounding
land uses and terrain.
d. The site has legal access.
C. There are no significant environmental features affecting the site, except the noted
Special Flood Hazard Area.

WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on February 9, 2005, the Commission recommended. APPROVAL for an Extension of Time for a
Zoning Use Permit subject to the following:
1. This Extension of Time of the Zoning Use Permit is approved for three years and expires
on March 7, 2008. An application for another Extension of Time must be applied
for prior to the expiration date of the Board of Supervisors Resolution.
2. All dogs kept or maintained longer than 30 days must meet all the appropriate State
Statutes covering Rabies Vaccinations.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, on February 20, 2005, and was posted on
February 18, 2005, as required by Arizona Revised Statutes and the Mohave County Zoning
Aft Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular
meeting on Monday, March 7, 2005, APPROVED this Extension of Time for a Zoning Use Permit as
recommended by the Mohave County Planning and Zoning Commission and outlined herein.

A RESOLUTION SETTING FORTH FOR RENEWAL OF A ZONING USE PERMIT ON THE
NORTH 570 FEET OF THE WEST 1,389.5 FEET, EXCEPT THE WEST 1,109.5 FEET OF THE
N 1/2 OF SECTION 22, TOWNSHIP 23 NORTH, RANGE 13 WEST, FOR A DOG KENNEL IN
AN A -R/36A (AGRICULTURAL- RESIDENTIAL/THIRTY -SIX ACRE MINIMUM LOT SIZE)
ZONE, IN THE MOHAVE COUNTY GENERAL AREA, MOHAVE COUNTY, ARIZONA.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on
February 4, 2008, a public hearing was conducted to determine whether Renewal of a Zoning Use
Permit should be granted for the above- described property as requested by Ernest R. Schoop
representing A Place of Hope Dog Rescue Foundation of Valentine Arizona, and
WHEREAS, this property is located southeast of State Highway 66, approximately one mile
south of Valentine, Arizona. The site is accessed from State Highway 68, via east on an unnamed dirt
road approximately six - tenths (0.6) of a mile to the southeast comer of the property. The property has a
single - family residence and an accessory building on it. The terrain is gently rolling hills, sloping
generally to the north. The surrounding land uses consist of vacant land. There are no significant
drainage patterns. The Mohave County General Plan designates this area as a Rural Development Area,
and
WHEREAS, this Zoning Use Permit for the "A Place of Hope Dog Rescue Foundation" dog
kennel on this property in an A -R/36A (Agricultural- Residential /Thirty -six Acre Minimum Lot Size)
zone was conditionally approved by the Mohave County Board of Supervisors on January 7, 2002, via
BOS Resolution No. 2002 -019 for an initial period of three years, with subsequent renewals. It was
renewed for the first time with BOS Resolution No. 2005 -100 on March 7, 2005. The parcel contains
3.46 acres but appears to have been created prior to the passage of P &ZC Resolution 87 -67 which down -
zoned this property and those adjacent from A -R. to A- R/36A, and
WHEREAS, this Extension of Time will renew and continue a dog kennel approval, as required
by BOS Resolution No. 2002 -019. The applicant requested this renewal in his application of November
6, 2007, and
WHEREAS, the property owner has accomplished all the conditions of approval as required by
BOS Resolution No. 2002 -019, and
WHEREAS, this will be the second Renewal for this property, and
no

on January 9, 2008, the Commission recommended APPROVAL for a Renewal of a Zoning Ilse Permit
subject to the following:
1. Compliance with the conditions of BOS Resolution No. 2002 -019,
2. This extension of Time will be in effect until March 7, 2011. An application for
another Renewal must be applied for prior to the expiration date.
3. All dogs kept or maintained longer than 30 days must meet all the appropriate State
Statutes covering rabies vaccinations.
WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, on January 20, 2008, and was posted on
January 18, 2008, as required by Arizona Revised Statutes and the Mohave County 'Zoning Regulations.
NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular
meeting on Monday, February 4, 2008, APPROVED this Renewal of a Zoning Use Permit as
recommended by the Mohave County Planning and Zoning Commission and outlined herein.
