MOHAVE COUNTY ORDINANCE NO. 2011-10
AN ORDINANCE AMENDING THE MOHAVE COUNTY GENERAL PLAN TO UPDATE
VARIOUS TEXTUAL REFERENCES IN THE MOHAVE COUNTY GENERAL PLAN TO
REFLECT NEW CITATIONS IN ARIZONA REVISED STATUTES THAT RESTRUCTURE
AND CLARIFY COUNTY PLANNING AND ZONING ENABLING PROVISIONS PER
SENATE BILL 1206,FORTY-NINTH LEGISLATURE, SECOND REGULAR SESSION,2010.
WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on
September 12, 2011, a public hearing was conducted to determine whether approval should be granted
to amend various sections of the Mohave County General Plan, as requested by the Mohave County
Development Services Department, and
WHEREAS, the language to be added has been bolded and underlined and the language to be
removed has been struck, and
WHEREAS, the Forty-ninth Arizona State Legislature, at its Second Regular Session in 2010,
approved Senate Bill 1206 which has renumbered several sections of the state statutes dealing with
county planning and zoning functions effective on October 1, 2011. These changes are designed to
restructure and clarify county planning and zoning enabling provisions. The Department proposes to
amend the Mohave County General Plan by amending the references to the renumbered statutes, and
WHEREAS, the Arizona legislature makes changes in the statutes on a regular basis, and using
specific statutory citations, although useful in some instances, can cause confusion and misguide the
general public when the legislature has amended related sections. The Department proposes to amend
the specific citations in the General Plan to a more general reference to the statutes, as amended, and
WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission
on August 10, 2011, the Commission recommended APPROVAL for this Ordinance, and
WHEREAS, the notice of hearing was published in The Kingman Daily Miner, a newspaper of
general circulation in Kingman, Mohave County, Arizona, August 28, 2011 and posted August 26, 2011,
as required by Arizona Revised Statutes and the Mohave County Zoning Regulations.

NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular
meeting on Monday, September 12, 2011, APPROVED this Ordinance as recommended by the Mohave
County Planning and Zoning Commission and outlined herein.
1. Amend Section IV, The Planning Process,A. Introduction(page 35) as follows:
"These updates and revisions should occur at least every 10 years per Growing Smarter Plus
(ARS §11 821 A.R.S. 11-805)."
2. Amend Section VI, Community Development, A. Land Use Element, 1. Land Use, Policy 27.7.d
(page 99) as follows:
"The Board of Supervisors may determine that any proposal requiring an amendment to the
General Plan constitutes a minor amendment if it finds, consistent with ARS 11 824, et. seq.
A.R.S. 11-805, that the proposal is beneficial to the county,"
3. Amend Section IX, Plan Implementation, F. Review of the General Plan, 1. Amendments (page
156) as follows:
"Policies relating to amendment of this General Plan are found in Goal 27 of the Land Use
Element. Plan amendment processing, governed by ARS §§ 11 824, as amended A.R.S. 11-805,
is incorporated into the County zoning regulations."
4. Amend Section X, Appendices, A. Glossary of Terms, Zoning(page 166) as follows:
"A division of the county by ordinance into areas, or zoning districts, that specify allowable uses
for property, allowable building area and size limitations for buildings; the process of zoning as
described in ARS 11 821 through ARS 11 821 A.R.S. 11-804, 11-805, and 11-811; a tool or
program intended to implement the policies of the General Plan."
5. Amend Section X, Appendices, Appendix I (page 186) as follows:
"By supporting and monitoring efforts to quantify supplies and demands, Mohave County can
better plan for the long term water demands for residents and businesses as required by ARS
§11 821.C.3 A.R.S. 11-804."
