WHEREAS, at the regular meeting of the Mohave County Board of Supervisors held on August 6, 2012, a public hearing was conducted to determine whether approval should be granted to amend Section 6, Incorrect or Omitted Information, to clarify the minimal level of information necessary to review an application, as requested by the Mohave County Development Services Department, and WHEREAS, Section 6, of the Mohave County Zoning Ordinance, currently provides that incorrect information or statements, or information omitted by applicants, such that its omission might alter the conditions on which any approval of permit, variance, appeal, or change was being considered, is sufficient basis for termination of any proceedings in process, and WHEREAS, the provisions of Arizona Revised Statutes Sections 11-1601 through 11-1610, which were passed by the Arizona Legislature in 2011, generally require counties to provide some specificity in ordinances setting out the requirements for applications and the conditions that may be applied to approvals. The changes proposed for Section 6 of the Mohave County Zoning Ordinance would state some basic minimum requirements for all applications. Other sections of the Ordinance may require additional adjustments more closely tailored to the requirements of those sections, and WHEREAS, the proposed new language to be added has been bolded and underlined; language proposed to be removed has been struck, and WHEREAS, at the public hearing before the Mohave County Planning and Zoning Commission on July 11, 2012,the Commission recommended APPROVAL for this Ordinance, and WHEREAS, the notice of hearing was published in the Kingman Daily Miner, a newspaper of general circulation in Kingman, Mohave County, Arizona, on July 22, 2012, and was posted on July 20, 2012, as required by Arizona Revised Statutes and the Mohave County Zoning Regulations. ORDINANCE NO. 2012-04 PAGE 2 NOW THEREFORE BE IT RESOLVED, that the Board of Supervisors, at their regular meeting on Monday, August 6, 2012, APPROVED this Ordinance as recommended by the Mohave County Planning and Zoning Commission and outlined herein. Amend Section 6 of the Mohave County Zoning Ordinance as follows: Section 6 INCORRECT OR OMITTED INFORMATION A. APPLICATION REQUIREMENTS: An application for a permit, variance, appeal, or change shall be considered incomplete if it does not include sufficient information to identify the applicant, identify the property involved, and describe the proposal. If the applicant does not own the property, written consent of the property owner will be required. If the applicant's ownership of the property is not reflected in the records of the County Assessor's Office, proof of ownership may be required. B. Incorrect information or statements or information omitted by applicants such that its omission might alter the conditions on which any approval of permit, variance, appeal, or change was is being considered, is sufficient basis for termination of to suspend or terminate any proceedings in process. Proceedings may resume after corrected or omitted information has been provided.
